The following citations have been recorded in the Tucker County Magistrate office:
- Justin D. Arnold, Hambleton, was cited for failure to report accident by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Carl R. Waybright, Buckhannon, was cited for speeding (29-25) by Deputy B.T. Zirk. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Eric D. Buchinger, Hendricks, was cited for no insurance by Cpl. D.W. Burge. The charge was dismissed with proof shown.
- Thomas F. Henlint, Jr. Oakland, Md. was cited for speeding (34-25) by TFC J.J. Schmidle. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Leonardo V. Villar, Eglon, was cited for no insurance and expired registration by Cpl. D.W. Burge. The first charge was dismissed with proof shown. He pled guilty to the second charge and was assessed fines of $4.75 and court cost of $165.25.
- Zachary C. Kapp, Clarksburg, was cited for failure to control by SNRPO Donald B. McFarlan. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Ryan M. Crosten, Marlinton, was cited for speeding (39-25) by Deputy B.T. Zirk. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Emily M. Haines, Kitzmiller, Md. was cited for speeding (29-25) by Deputy B.T. Zirk. She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Maria M. Romo Avalos, North Chesterfield, Va. was cited for speeding (55-45) and driving suspended operators by Cpl. D.W. Burge. She pled no contest to both charges and was assessed fines of $104.75 and court cost of $330.50.
- Diana C. Goddard, Charles Town, was cited for speeding (34-25) by Deputy B.T. Zirk. She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Michael K. Thompson, Summersville, was cited for speeding and no proof of insurance. He pled guilty to the first charge ad was assessed fines of $4.75 and court cost of $165.25. The second charge was dismissed with proof shown.
- Michelle D. Haskins, Fredricksburg, Va. was cited for speeding (35-25) and driving suspended by TFC J.J. Schmidle. She pled guilty to both charges and was assessed fines of $104.75 and court cost of $330.50.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- James Ray Waybright, Parsons, was charged with three felony counts of failure to register as a sexual offender and provide registration changes. The complaint states that on Tuesday, Jan. 30 the defendant came into the Parsons Detachment of the West Virginia State Police to complete his annual sex offender registration. He stated there were no changes and completed the said registration. When he left the parking lot, the vehicle he left in did not resemble to 2002 Dodge Neon on his registration. Upon further investigation it was learned that the Neon was not seen at the defendant’s residence any longer. However there was a 2003 silver Chevrolet Cavalier with no registration plate and a 2002 silver Pontiac Sunfire bearing a WV registration. It was registered in his wife’s name. On Wednesday, Feb. 14 Sgt. C.D. Siler traveled to the defendant’s residence and observed both vehicles in the driveway. He went to the door and spoke with Waybright. He allegedly stated it wasn’t his car but it belonged to his wife. The sex offender is required to register any vehicle that he may have access to on a regular basis. Siler informed him to come to the office to make the changes. Once at the office, Siler asked Joy Waybright about the vehicles. She stated they got rid of the 2002 Dodge Neon February of 2017 and purchased the 2003 Cavalier in June of 2017. She stated the motor blew up about a month later and they purchased the 2002 Sunfire around September 2017 and transferred the registration. The defendant still had the Cavalier and the Sunfire which neither one had been registered on his Sex Offender registration. Not did he register that he had gotten rid of the Neon. The defendant had come into the Parsons Detachment on Jan. 19, 2017 and completed his annual registration. He did not return to the Parsons Detachment until Jan. 30, 2018 to complete his registration for 2018. During this time period there were three vehicle changes that should have been documented. He is being housed at the Tygart Valley Regional Jail.
- Kimberly Marie Swecker, Elkins, was charged with Driving Suspended for Misc. Third Offense. The complaint states that on Sunday, Feb. 18 Cpl. D.W. Burge drove through the Parsons Shop-n-Save parking lot and observed the defendant in the driver seat of a Sebring. He contacted Tucker 911 to check her driver’s license status and was advised that her license had been suspended effective Aug. 27, 2015. a prior conviction effective June 24, 2016 , a prior conviction effective June 19, 2017 and a prior conviction effective Jan. 16, 2018. Burge allegedly observed Swecker drive south on US219. He initiated a traffic stop and asked the defendant for her driver’s license, insurance and registration cards. She advised that she did not have her license with her and that she was suspended. Burge arrested her for driving on a suspended operator’s third offense. She posted a $500 PR bond and a Bench Trial is scheduled for April 23 at 10 a.m. before Magistrate Riley H. Barb.
- Christian P. Burkhammer, Parsons, was charged with Truancy. The complaint states that he failed to regularly attend Tucker County High School and has accumulated 18 full unexcused days. He posted a $50 PR bond and a Bench Trial is scheduled for March 28 at 11 a.m. before Magistrate Riley H. Barb.
- Carley Brooke Eye, Eglon, was charged with Battery and Shoplifting. The complaint states that on Feb. 21 at 7:30 a.m. F/Sgt. K.L. Keplinger received notification of a disturbance at the BFS Store in Davis. He responded and located a white female in a vehicle in the parking lot. Several individuals indicted that the female was the subject that caused the disturbance. Keplinger contacted the female who initially identified herself as Hallie Cussins, but then stated her real name. She seemed to be in a very manic state and exhibited erratic behavior. She stated that the kids and dog in the car parked across from her was hers and that they shared them. The male on scene advised he had no idea who she was and had had no prior contact with her. He further stated that Eye had allegedly attempted to enter his vehicle several times but had not. Eye gave Keplinger five (5) three dollar WV lottery tickets that she stated that she had allegedly stolen from the BFS Store. She was taken into custody and the officer spoke with a store employee. She advised that Eye came into the store and allegedly stated she needed lottery tickets to take care of her mother. She then removed 4 lottery tickets which the clerk recovered. Eye then removed five lottery tickets and left the store. The clerk stated that the defendant allegedly grabbed her by the arm during the incident and red marks were observed on her arm. A cash bond of $1,000 was not posted.
- David Bruce Feineis, Virginia Beach, Va. was charged with DUI – .15 or higher BAC. On Sunday, Feb. 18 TFC J.J. Schmidle responded to a two vehicle crash on Timberline Rd in Davis. Once on scene he identified the driver as Feinies and could smell the distinct odor of an alcoholic beverage on his breath. He explained and conducted three field sobriety tests which the defendant failed. The officer conducted a PBT test on the defendant with a result of a .210% BAC. He pleced him under arrest for DUI and transported him to Parsons Police Department to administer a secondary chemical test. The second test results were .202%BAC. He was processed and transported to Tygart Valley Regional Jail. A $1,500 PR bond was posted.
The following case has been ordered and adjudged in the Tucker County Magistrate Court:
- Suesli verses Watson: On Feb. 15 the court granted in favor of Debra Kay Suesli against Aaron Cale and Amber Watson in the amount of $5,150 plus $70 court cost. They must vacate the property by Feb. 25. This case was heard on Feb. 18 by Magistrate William M. Miller.
