The following citations have been recorded in the Tucker County Magistrate office:
- Danny C. Mitters, Mt. Storm, was cited for failure to yield highway by K.L. Keplinger. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Taryn B. Dibartolomeo, Parsons, was cited for expired MVI and expired registration by Cpl. D.W. Burge. She pled no contest to both charges and was assessed fines of $9.50 and court cost of $330.50.
- Christopher R. Fortney, Elkins, was cited for driving suspended and no insurance by Deputy C.A. Teter. He pled no contest to both charges and was assessed fines of $9.50 and court cost of $330.50.
- Scott A. Poling, Harman, was cited for speeding (29-25) by TFC J.J. Schmidle. He pled no contest and was assessed fines of $475 and court cost of $165.25.
- Seth A. Evans, Hambleton, was cited for speeding (64-55) by Deputy C.R. Donelson. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Evan L. Dravenstott, Hambleton, was cited for failure to keep right by Cpl. J.E. Kopec. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Jacob R. Biser, Keyser, was cited for texting while driving by Cpl. D.W. Burge. He pled no contest and was assessed fines of $100.
The following criminal complaints have been filed in the Tucker County Magistrate office:
- Levi Garrett McCauley, Kerens, was charged with Driving Revoked for DUI. According to the complaint on Thursday, March 15 at approximately 4:12 p.m. Tucker County Sheriff Brian Wilfong contacted Deputy C.A. Teter for assistance along WV72 near the old gas station in Parsons. Upon arrival Teter met with Wilfong who stated that he was on patrol on WV72 when he observed a black Mustang driven by a white male pull off the main road and into a private drive. Wilfong was familiar with the vehicle and believed that the driver Levi McCauley had an outstanding arrest warrant for his arrest and that the driver’s right to operate a vehicle had been revoked for DUI. He further stated that the driver and his passenger had switched places while at this driveway and was attempting to pull back on WV72 when he made contact with the vehicle. Garrett had been arre4sted and convicted for at least two prior charges of Driving Revoked for DUI. It should be noted that both subjects admitted that the defendant had been driving. The vehicle registration did not belong to this vehicle. He was arrested and transported to TVRJ and is under a 10% cash bond of $5,000.
- Emily Jo Heckler, Parsons, was charged with Indecent Exposure and Obstructing an Officer. The complaint states that on Sunday, Feb. 25 at approximately 7:12 a.m. Cpl. D.W. Burge was advised by Tucker County 911 that the defendant was walking toward Parsons Sheetz in only her underwear. He traveled to the store and observed the defendant allegedly entering the store without any clothing covering her body. He entered the store and advised her she was under arrest, to turn around and place her hands behind her back. She did not comply and upon placing the handcuffs on her she allegedly attempted twice to pull away from Burge. He asked her why she was naked in public again and she advised “I don’t know.” She is under a $1,500 cash bond.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses Tiffany Nicole Henline: She received judgment of Motion by the Prosecuting Attorney to dismiss – Granted by the Magistrate – No fees charged on the case for one count Battery upon another by making physical contact which occurred on Aug. 15, 2017. This case was dismissed without prejudice on March 20 by Magistrate William M. Miller.
- State of West Virginia verses Paul Andrew Shaver: Received judgment of preliminary hearing waived for one count forging, uttering or attempting to employ as true, a forged writing to the prejudice of another which occurred on Dec. 29, 2017. This case was bound over to the Tucker County Circuit Court. It was heard on March 16 by Magistrate Riley H. Barb.
- State of West Virginia verses Paul Andrew Shaver: Received judgment of preliminary hearing waived for one count forging, uttering or attempting to employ as true, a forged writing to the prejudice of another which occurred on Jan, 5. A $10 fee was assessed on the case. This case was bound over to the Tucker County Circuit Court. It was heard on March 16 by Magistrate Riley H. Barb.
- The Dunbar Sanitary Board verses Poythress: On March 19 the Court granted Dismissed against Ronald Wayne Poythress. The case was dismissed with prejudice. The case was heard by Magistrate William M. Miller.
- Stone verses Fansler: The court found in favor of Karen Stone against Kenneth Ray Fansler and Renee M. Fansler in the amount of $650 and court cost of $105. They must vacate premises by March 30. This case was heard on March 15 by Magistrate William M. Miller.
The following cases were heard in Tucker County Circuit Court:
- State of West Virginia verses Mitchell Adams: This matter came before Judge Lynn Nelson by motion on March 21 and the Court does find that the case of Conspiracy is appropriate to be dismissed without Prejudice.
- State of West Virginia verses Britni M. Ball: This matter came before Judge Lynn Nelson by motion on March 21 and the Court does find that the case of Conspiracy is appropriate to be dismissed without Prejudice.
- State of West Virginia verses Staci D. Smith: This matter came before Judge Lynn Nelson by motion on March 21 and the Court does find that the case of Conspiracy is appropriate to be dismissed without Prejudice.
- State of West Virginia verses Jesse D. Suesli: This matter came before Judge Lynn Nelson by motion on March 21 and the Court does find that the case of Conspiracy is appropriate to be dismissed without Prejudice.
