The following citations have been recorded in the Tucker County Magistrate office:
- James C. Paris, III, Elkins, was cited for expired MVI by First Sgt. G.P. Doyle. He pled no contest and was assessed fines of $4.75 and court cot of $165.25.
- Nicole I. Ware, Mabie, was cited for speeding (34-25) by Deputy B.T. Zirk. She pled guilty and was assessed fines of $4.75 and court cost of $165.25.
- Thomas W. Klevan, Bethal Park, Pa. was cited for speeding (35-25) by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Kristin Saddler, Thomas, was cited for failure to stop at stop sign by Cpl. D.W. Burge. She pled no contest and was assessed fines of $4.75 and court cot of $165.25.
- Sheldon D. Niemenski, Hambleton, was cited for expired MVI by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Michalla G. Beatty, Belington, was cited for no MVI by Cpl. D.W. Burge. She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Charles E. Richard, Davis, was cited for expire registration by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Trista R. Harper, Parsons, was cited for no insurance by Cpl. D.W. Burge. The charge was dismissed with proof shown.
The following criminal complaint has been filed in the Tucker County Magistrate Court:
- Christopher Allen Marple, Bittinger, Md. was charged with leaving the scene of accident (property damage). The complaint states that on Saturday, June 30, the defendant was driving a green ATV with an add-on LED light bar along a gravel road between the Thomas Railroad grade and WV32 near the Thomas post office. He allegedly drove into a red Chevrolet Sonic occupied by the owner causing approximately $1,600 in damage. The victim exited her vehicle to ask for his insurance information and he fled the scene without providing said information. He failed to contact local police and report the accident. The victim contacted the WV State Police to report the accident and that the driver fled the scene. Cpl. D.W. Burge obtained witness statements that provided information that Marple was driving the ATV. Burge contacted the defendant several times over the phone in an attempt to obtain a driver statement for the accident and he failed to meet with Burge. He posted an $800 PR bond and a court hearting is scheduled for September 17 before Magistrate William M. Miller.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses Timothy S. Stonesifer, Thomas, received judgment of no contest per plea agreement for one count driving while license suspended or revoked which occurred on June 17. He was assessed fines of $100 and cost and fees of $165.25. This case was heard on June 30 by Magistrate Riley H. Barb.
- State of West Virginia verses Kevin McDermott, Davis, received judgment of Motion by the Prosecuting Attorney to dismiss – Granted by the Magistrate – No fees charged on the case for one count improper use of evidence of registrations. Motion by the state to dismiss – dealership in error on purchase – granted. This case was heard on July 30 by Magistrate Riley H. Barb.
- State of West Virginia verses James Waybright, Parsons, received judgment of Preliminary hearing waived for one felony count of failure to register or provide notice of registration change which occurred on Feb. 14. A $10 fee was assessed and the case was bound over to Tucker County Circuit Court. This case was heard on July 30 by Magistrate Riley H. Barb.
- State of West Virginia verses John Michael Harris, Dry Fork, received judgment of Preliminary hearing waived for one felony count wanton endangerment involving a firearm which occurred on June 29. A $10 fee was assessed and the case was bound over to Tucker County Circuit Court. This case was heard on July 27 by Magistrate William M. Miller.
- State of West Virginia verses Maliyah Dane Smith, Parsons, received judgment of no contest plea agreement for two counts obscene, anonymous, harassing repeated and threatening telephone calls. She was assessed cost and fees of $165.25; a six month suspended jail sentence and six months unsupervised probation. She also received judgment of dismissed by Magistrate – State for one count harassment – repeatedly making credible threats against another – per plea agreement. This case was heard on July 24 by Magistrate William M. Miller.
