The following citations have been recorded in the Tucker County Magistrate office:
- Mark D. Crosten, Parsons, was cited for cell phone use by Sgt. C.D. Siler. He pled no contest and was assessed fines of $100.
- Donna M. Mullennex, Parsons, was cited for expired MVI and expired registration by Cpl. D.W. Burge. The first charge was dismissed and she pled no contest to the second charge. She was assessed fines of $4.75 and court cost of $165.25.
- Erik C. Curran, Davis, was cited for no proof of insurance by Deputy B.T. Zirk. The charge was dismissed with proof shown.
- Maddison J. McGowan, Cambridge, Md. was cited for speeding (75-65) by Cpl. D.W. Burge. She pled guilty and was assessed fines of $10 and court cost of $165.25.
- Maliyah D. Smith, Parsons, was cited for expired MVI and expired registration by Cpl. D.W. Burge. She pled no contest to both charges and was assessed fines of $9.50 and court cost of $330.50.
- John T. Maxwell, Fairmont, was cited for speeding (35-25) by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Randy Scott Shull, Parsons, was charged with one felony charge of Second Degree Murder. According to the complaint, on July 26 at approximately 3:55 a.m. acting Chief Deputy C.R. Donelson, of the Tucker County Sheriff’s Office, was dispatched to 75 Retriever Rd. for an unresponsive female with no pulse. Upon arrival, Donelson observed the defendant on the couch allegedly stating “I killed her” and “I only pushed her.” Donelson took the defendant into custody and transported him to the Parsons Detachment of the West Virginia State Police for processing. Shull was read his rights, signed the form and agreed to an interview. During the interview, conducted by Sgt. C.D. Siler and Deputy Donelson, Shull allegedly stated that he and the decedent, Katherine Lillie, had been arguing off and on for the past three days. He allegedly stated that around 2 a.m. they were engaged in a verbal altercation when it turned physical. He allegedly stated that he pushed her, yelling “get the **** away from me.” She stumbled and fell on the floor and came to rest with her head against the wall. She was later pronounced dead on scene.
- Douglas Grant Canon, Davis, was charged with Petit Larceny. The complaint states that on Monday, July 17 at approximately 11:15 a.m. Deputy B.T. Zirk, of the Tucker County Sheriff’s Office, and Cpl. D.W. Burge, of the West Virginia State Police, were dispatched to 23079 Seneca Trail in Thomas for a male subject who was allegedly trying to take items from an out building that did not belong to him. Upon arrival, the officers observed the property owner (Richard Elwood Knotts) along with his wife and their son-in-law, blocking the driveway with their vehicle. The officers were directed to the defendant who was sitting in his truck. Zirk asked the defendant what was going on and he stated that he was having money trouble so he was taking stuff out of the building to sell for money. He also allegedly stated that he knew it was wrong and he should not have done it. A $2,000 PR bond was posted and a court hearing is scheduled for Sept. 7 at 10 a.m. before Magistrate William M. Miller.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses Alice Smith, Parsons, received judgment of Motion by the Prosecuting Attorney to dismiss-Granted by the Magistrate-No fees charged on the case for one count unlawful acts by persons, Alcohol (Purchasing for minors) which occurred on April 13. Motion to dismiss by State due to witness being uncooperative-Granted. This case was heard on July 19 by Magistrate Riley H. Barb.
- State of West Virginia verses Matthew Logan Lipscomb, Hendricks, received judgment of Dismissed-plea agreement for one count failure to appear which occurred on May 16. This case was heard on July 25 by Magistrate William M. Miller.
- State of West Virginia verses Patricia Lynn Earhart, Hedgesville, received judgment of motion by Prosecuting Attorney to dismiss-Granted by the Magistrate-no feed charged on the case for one count Domestic Battery which occurred on May 18. Motion to dismiss without prejudice-Granted. The defendant is to provide proof of anger management class. This case was heard on July 21 by Magistrate Riley H. Barb.
- North Central WV CAA verses Roy, received judgment in favor of North Central WV CAA against Cheyenne Davis and Trevor Roy in the amount of $424 plus $100 court cost and must vacate property by July 31. This case was heard on July 20 by Magistrate Riley H. Barb.
- State of West Virginia verses Nicholas A. Owens, Belington, received judgment of guilty-plea agreement for one count reckless driving and one count driving on right side of road. He was assessed fines of $100 and court cost of $330.50.
