The following citations have been recorded in the Tucker County Magistrate office:
- Denver J. Cussins, Hambleton, was cited for driving suspended by Cpl. D.W. Burge. He pled no contest and was assessed fines of $100 and court cost of $165.25.
- Benny D. Pennington, Parsons, was cited for expired registration by Cpl. D.W. Burge. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Justin W. Sacks, Parsons, was cited for loaded rifle in vehicle and taking a buck during doe season. He was assessed fines of $40 and court cost of $330.50.
- Shane S. Shaffer, Parsons, was cited for driving suspended and no proof of insurance by Deputy B.T. Zirk. He pled no contest to the first charge and was assessed fines of $100 and court cost of $165.25. The second charge was dismissed with proof shown.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Christophe John Alan Petty, Lancaster, Ohio, was charged with Violation of Domestic Violence Order. The complaint states that on Wednesday, Aug. 9 a Proptective Order was served on the defendant. On Thursday, Aug. 10 at 1:51 p.m. the petitioner began receiving text messages from an unfamiliar number allegedly claiming to be Dustin, who is a friend of the defendant. Dustin had texted her phone from a different number speaking with the defendant prior to this domestic incident. The two numbers do not match. Sgt. C.D. Siler called the number that was texted to her on this date. After the defendant hung up on Siler during the first conversation, Siler called back and did speak with him. The defendant allegedly stated this phone was Dustin’s however they both were present while Siler was speaking to the defendant. The victim stated that she only spoke with Dustin while he was moving out of his apartment so it was very unusual that he would text and ask how she was doing. The defendant used Dustin’s phone or had Dustin text the victim. A cash bond of $200 was not posted and a bench trial is scheduled for Oct. 10 at 10:30 a.m. before Magistrate William M. Miller.
- Jeffrey Paul Boyles, Parsons, was charged with Violation of a Protective Order. According to the complaint, on Friday, June 23 at approximately 6 p.m. the victim, Sheena Christy Boyles, arrived at the Parsons State Police Detachment to file a complaint for the crime of violation of a protective order. Cpl. J.E. Kopec obtained a written statement summarizing that a current protective order is in effect. Mrs. Boyles started that while conducting a scheduled child exchange on June 23, Boyles approached her and smacked her on the bottom and allegedly exchanged lewd remarks to her boyfriend. The defendant wanted to talk to her and she stated that a protective order was in effect. The defendant was trying to get the boyfriend to fight and he allegedly stated that he watched the defendant put his hands on Mrs. Boyles. The boyfriend’s mother made the same statement. A $2,000 PR bond was posted.
- Dusty Robert Whitacre, Bayard, was charged with False Information to Trooper. The complain states that on Thursday, Aug. 10, Sgt. C.D. Siler was working a violation of DVP on Christophe Petty. The petitioner started getting text messages from a phone belonging to the defendant. When interviewed about the messages, the defendant allegedly stated that he had gone to the petitioner’s residence to get a phone and some items for Pett. He stated that when he was leaving the petitioner had given him her telephone number and told him to text if he wanted. Siler contacted the petitioner who stated that she had not given the defendant her number and she did not tell him to text her. Also, during this interview, the defendant allegedly changed his story about why he texted her at least twice and then denied what he had previously said. Siler gave the defendant several opportunities to tell the truth, but he refused. A cash bond of $200 was posted and a court hearing is scheduled for Oct. 3 at 10:30 a.m. before Magistrate William M. Miller.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses Justin W. Sacks, Parsons, received judgment of dismissed for one count expired registration, one count driving while license suspended or revoked and one count misdemeanor offenses for violation of protective order, all of which occurred on Aug. 1. A motion was granted to transfer to Circuit Court. These cases were heard on Aug. 10 by Magistrate William M. Miller.
- State of West Virginia verses Daniel Bean, Keyser, received judgment of preliminary hearing waived for one count conspiracy and one count receiving or transferring stolen goods with a violation date of May 31. He was assessed a $20 fee and the case was bound over to Circuit Court. This case was heard on Aug. 15 by Magistrate William M. Miller.
- State of West Virginia verses Danielle Bean, Keyser, received judgment of Probable Cause Found for one count conspiracy and one count receiving or transferring stolen goods. This case was heard on Aug. 15 by Magistrate Riley H. Barb and was bound over to Circuit Court.
- State of West Virginia verses Justin W. Sacks, received judgment of Preliminary Hearing Waived for one count manufacture/deliver/possess with intent to manufacture/deliver (Schedule I or II Narcotic) which occurred on Aug.1. A $10 fee was assessed and the case was bound over to Circuit Court. The case was heard on Aug. 10 by Magistrate William M. Miller.
- Federal National Mortgage Asso verses Simpson, On Aug. 10 in this case the court granted judgment of dismissed against Bruce E. Simpson, Jody L. Simpson and any Current Occupants. The plaintiff no longer wishes to pursue this matter in the Magistrate Court. This case was heard on Aug. 10 by Magistrate William M. Miller.
