The following citations have been filed in the Tucker County Magistrate office:
Sampson O’Dell, of Gormania, was cited for improper registration and no MVI by Cpl. M.S. Wetzel. He pled no contest on both charges and was assessed fines of $9.50 and court costs of $330.50.
Barbara Ann Wood, of Thomas, was cited for no seatbelt by Sgt. C.D. Siler. She pled no contest and was assessed fines of $25.
Charles E. Rexroad, of Martinsburg, was cited for no seatbelt by Sgt. C.D. Siler. He pled no contest and was assessed fines of $25.
Justin Gregory Dawson, of Westernport, Md., was cited for speeding (59-45) by Sgt. C.D. Siler. He pled guilty and was assessed fines of $4.20 and court cost of $165.80.
Eric Bijan Sarlati, of Thomas, was cited for no MVI by Dep. C.R. Teter. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
Malcomb C. Roy, of Thomas, was cited for expired registration and no proof of insurance. He pled no contest to the first charge and was assessed fines of $4.75 and court cost of $165.25. Second charge was dismissed with proof shown.
James Allen Bedford, of Montrose, was cited for loaded gun in vehicle and no blaze orange by Terry Fluharty. He pled not guilty to the first charge and was assessed fines of $5 and court cost of $165.25 for the second charge.
Carrie L. Hanlon, of Hendricks, was cited for expired MVI and no proof of insurance by Trp. J.E. Kopec. Both charges were dismissed.
George J. Potter, of Ferdinand, Ind., was cited for speeding (65-45) by Sgt. C.D. Siler. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
The following criminal cases have been assigned in the Tucker County Magistrate Court:
Aaron Spencer Turner, of Davis: According to the criminal complaint, on Wednesday, April, 16, after failing to appear at a scheduled court preceding whereas the defendant was arrested and charged for two violations of the law, Deputy C.R. Teter of the Tucker County Sheriff Department allegedly hand delivered and served a Tucker County Magistrate Court Notice to Appear on the defendant for court on June 10, at the Tucker County Magistrate Court. On Tuesday, June 10, at 11-11:30 a.m. the defendant failed to appear at the required court to answer for the two charges after being served by Teter notice of said court date. Turner had bail set at $10,000 PR bond.
Jesse William Florentine, of Eglon: According to the criminal complaint, on Wednesday, April, 16, after failing to appear at a scheduled court preceding whereas the defendant was arrested and charged for a violation of the law, Deputy C.R. Teter of the Tucker County Sheriff Department allegedly hand delivered and served a Tucker County Magistrate Court Notice to Appear on the defendant for court on June 10, at the Tucker County Magistrate Court. On Tuesday, June 10, at 11:30 a.m. to noon the defendant failed to appear at the required court to answer for the two charges after being served by Teter notice of said court date. Florentine had bail set for $5,000 PR bond.
Jeff A. Yuchek, of Parsons: According to the criminal complaint filed by Trooper J.E. Kopec of the Parsons Detachment of the West Virginia State Police, at approximately 2:45 p.m. on Saturday, June 7 a blue Chevrolet Cobalt was struck by a green Subaru Outback along US219. The Outback was allegedly driven by the defendant. Yucheck, allegedly left the scene of the accident but returned a short time later and told Kopec he was drunk and just take him to jail. While the officer conducted his investigation, the driver and passenger of the other vehicle were being transported by life flight for their injuries. After failing to complete field sobriety tests, Yuchek was arrested for DUI with bodily injury, failure to keep right and failure to maintain control.
The following cases were heard in Tucker County Circuit Court:
Philip A. Phillips, Sr, of Davis, was originally indicted in February, but those charges were dismissed in March because of incorrect information in the original indictment. Those charges could not be brought up again because they were dismissed without prejudice.
On Tuesday, June 2, Phillips was charged with three counts of second degree sexual assault, one count of first degree sexual abuse, six counts sexual abuse by parent or guardian and 2 counts third degree abuse. On June 9, before Judge Lynn A. Nelson, bond was set at $10,000, he is to have no contact with victims and a pre-trial conference has been scheduled for July 12 at 9:30 a.m.
James Waybright, of Parsons, was originally indicted on one count of first degree sexual assault. Waybright allegedly had intercourse with the victim on July 4, 2013 after she told him she did not want to have sex with him. A pre-trial hearing has been set for July 10 at 9:30 a.m.
Charles W. Miller, Jr., of Thomas, was originally indicted on three counts of sexual assault in the third degree, three counts of abuse of an incapicated person and three counts of sexual abuse by parent or guardian. Nelson set bond for Miller at $25,000 PR and a pre-trial hearing is set for July 10 at 9:30 a.m. Miller is to have no contact with the alleged victim.
George Keihl was originally indicted for reporting a false claim. He is currently housed in the Tygart Valley Regional Jail but the Defendant and State agree that Keihl should undergo an independent psychiatric evaluation to see if he is a likely candidate for probation. Bond was set at $10,000 PR and a pre-trial conference is set for July 10 at 9:30 a.m.
Jessica Poe, of Hambleton, was placed back on her terms of probation after being arrested for violating those terms. Nelson ordered that Poe be released and must reenter the Community Corrections Program. Her term of probation had begun on January 16 and she will stay on probation for five years. She was indicted in October by a Tucker County Grand Jury for two felony counts of child neglect creating a risk of injury. She had been pulled over in August for reckless driving.
