The following citations have been recorded in the Tucker County Magistrate office:
- Ryan D. Stough, Martinsburg, was cited for speeding (60-45) and no proof of insurance by Cpl. J.E. Kopec. He pled no contest and was assessed fines of $4.75 and court cost of $165.25 for the first charge. The second charge was dismissed with proof shown.
- Robert S. Schreiber, Yardley, Pa. was cited for improper passing by Sgt. C.D. Siler. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Mellisa A. Bowley, Parsons, was cited for expired registration by Cpl. D.W. Burge. She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Jon C. Ketterman, Harman, was cited for no seatbelt by Sgt. C.D. Siler. He pled no contest and was assessed fines of $25.
- Donald A. Barkley, Timberville, Va. was cited for no seatbelt and no proof of insurance by Sgt. C.D. Siler. He pled no contest to the first charge and was assessed fines of $25. The second charge was dismissed with proof shown.
- Paul R. Gainer, Montrose, was cited for no proof of insurance by K.L. Keplinger. The charge was dismissed with proof shown.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Brian Austin Perkins, Davis, was charged with violation of domestic violence protective order. According to the complaint, on Wednesday, May 31, at approximately 12:53 p.m. acting Chief Deputy C.R. Donelson, of the Tucker County Sheriff’s office, was dispatched by Tucker County 911 to 177 Fourth Street, located in Davis, for an individual violating a DVPO. Donelson was advised by 911 that the victim, Lillian Mann, stated that the defendant was allegedly outside her front door. Perkins was issued a DVPO on Monday, May 29 which directed him not to be within 500 yards of the victim’s residence. Upon arrival, Donelson observed the defendant at the intersection of WV32 and Fourth Street, well within the 500 yards of her residence and was subsequently arrested without incident. The victim stated that around 1 p.m. she looked out the window and allegedly observed him on the deck and then observed him allegedly run and hide behind the stairs. He was transported to the Tucker County Sheriff’s office for processing to the Tygart Valley Regional Jail. A cash bond of $2,165.25 was not posted.
- Edward Marshal Kennard, Jr., Davis, was charged with DUI second offense and driving revoked for DUI. The complaint states that on Sunday, May 28, at approximately 11:27 a.m. Cpl. D.W. Burge, of the West Virginia State Police, was conducting road patrol on WV32 in Davis when he observed a Doge Caravan. The defendant was driving and not wearing a seatbelt. Burge observed him allegedly run off the roadway into a paved parking lot without giving a signal and avoiding a stop sign. Burge observed the Virginia registration to be the same which is not valid from a prior occasion with the defendant. The van did not have a MVI sticker affixed to the windshield. Burge knew from previous arrests that the defendant had a revoked driver’s license for DUI. He initiated a traffic stop and requested driver’s license, insurance card and registration card from the defendant. Kennard allegedly advised, “You know I don’t have any of that, can’t you just let me go, I’m going to the cemetery.” Burge observed the odor of alcohol and that his eyes were red, bloodshot and glassy. His speech was slow and slurred. He was asked to exit the vehicle and when he did, he was staggering and unsteady. An open can of beer was allegedly observed in the floor beside the driver’s seat. A breath test and field sobriety tests were initiated and the defendant failed. He was arrested for DUI second offense and was transported to the Parsons City Police Department for approved secondary breath test. The defendant failed the test with a .084 BAC. A court hearting is scheduled for June 27 before Magistrate William M. Miller.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses Justina Renee Wimer, Parsons, received judgment of Motion by the Prosecuting Attorney to dismiss-Granted by the Magistrate-No fees charged on the case for one count of Truancy. The defendant complied with terms of improvement period. This case was heard on May 25 by Magistrate William M. Miller.
- State of West Virginia verses Kimberly D. Mullenax, Parsons, received judgment of Motion by the Prosecuting Attorney to dismiss-Granted by the Magistrate-No fees charged on the case for one count of obstructing officer which occurred on March 1. This case was heard by Magistrate William M. Miller on May 31.
- State of West Virginia verses Tammy Lynn Wratchford, Parsons, received judgment of Motion by the Prosecuting Attorney to dismiss-Granted by the Magistrate-No fees charged on the case for one count of Truancy. The defendant complied with terms of improvement period. This case was heard on May 25 by Magistrate William M. Miller.
- State of West Virginia verses Steven J. Swiger, Farmington, received judgment of preliminary hearing waived for one count fleeing from officer which occurred on May 10. There was a $10 fee and this case was heard on May 25 by Magistrate William M. Miller.
- State of West Virginia verses Brandon R. Beale, Davis, received judgment of guilty-plea agreement for one count impeding or obstructing public official or employee from performing official duties which occurred on Dec. 10, 2016. He received a six month suspended jail term with home confinement for six months and credit for time served at Tucker County Community Corrections. This case was heard on May 30 by Magistrate William M. Miller.
