Magistrate News – May 31, 2017

The following citations have been recorded in the Tucker County Magistrate office:

  • Kimberly V. Davis, Manassas, Va. was cited for speeding (81-65) by Sgt. C.D. Siler.  She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
  • Edward M. Kennard, Davis, was cited for no insurance and no MVI by Deputy C.A. Teter.  He pled guilty to the first charge and was assessed fines of $4.75 and court cost of$165.25.  The second charge was dismissed with proof shown.
  • Marie E. Johnston, Bartow, was cited for no proof of insurance and expired registration by Deputy B.T. Zirk.  She pled no contest to both charges and was assessed fines of $204.75 and court cost of $330.50.
  • Virginia M. Skidmore, Weston, was cited for no insurance and expired MVI by Cpl D.W. Burge.  Both charges were dismissed with proof shown.
  • Shawel L. Bremigan, Belington, was cited for no insurance by Cpl. D.W. Burge.  The charge was dismissed with proof shown.
  • Justin M. Bolyard, Davis, was cited for speeding (59-55) by Deputy C.R. Donelson.  He pled no contest and was assessed fines of $4.75 and court cost of $165.25

The following criminal complaints have been filed in the Tucker County Magistrate Court:

  • Melinda Marie Simmons, Elkins, was charged with domestic battery.  The complaint states that on Thursday, may 18 at approximately 6 p.m. Cpl. D.W. Burge, of the Parsons Detachment of the West Virginia State Police, observed Patricia Earhart in a verbal altercation with Melinda Marie Simmons.  Both individuals walked around the corner near Sheets, in Parsons.  Burge observed a silver truck pull up near him and the female driver advised a fight was taking place around the corner between two females.  She advised that hair was allegedly being pulled and fists were swinging.  Burge traveled to the corner and observed two females allegedly covered in liquid, both crying and one female walking away from the area.  He asked both females what had occurred and was advised by both that Patricia Earhart had thrown a soda on Melinda Simmons.  Simmons allegedly threw a cup ofhot coffee on Patricia Earhart.  Earhart allegedly grabbed Simmons by the hair and threw her against the wall.  Earhart sustained minor burns on her arms, legs and chest from the coffee and Simmons sustained scrapes on her left arm.  She posted a $500 PR bond and a court hearing is scheduled for July 11 at 10 a.m. before Magistrate William M. Miller.

  • Matthew Logan Lipscomb, Hendricks, was charged with failure to appear.  According to the criminal complaint, on Tuesday, May 16 at 9:30 a.m. Lipscomb was scheduled to appear in Magistrate Court after being notified of said court hearing.  He failed to appear and a property/surety bond of $1,000 was posted.

The following cases have been ordered and adjudged in the Tucker County Magistrate Court:

  • St George Medical Clinic verses Cross:  Judgment was in favor of St. George Medical Clinic against Kevin Cross for $29.65 and court cost of $75.  This case was heard on May 16 by Magistrate Riley H. Barb.
  • St George Medical Clinic verses Dagmon:  Judgment was in favor of St. George Medical Clinic against Wendy Dagmon for $132 and court cost of $75.  This case was heard on May 16 by Magistrate Riley H. Barb.
  • St George Medical Clinic verses Kile:  Judgment was in favor of St. George Medical Clinic against Sierra Kile for $345 and court cost of $75.  This case was heard on May 16 by Magistrate Riley H. Barb.
  • St George Medical Clinic verses Moats:  Judgment was in favor of St. George Medical Clinic against Allen Moats for $25 and court cost of $75.  This case was heard on May 16 by Magistrate Riley H. Barb.
  • State of West Virginia verses Barbara A. Witck:  She received judgment of no contest plea for one count of making, issuing, worthless checks.  She was assessed fines of $1, cost and fees of $190.25 and restitution of $34.18.  She received judgment of no contest plea for one count of making, issuing, worthless checks.  She was assessed fines of $1, cost and fees of $190.25 and restitution of $32.12.  This case was heard on May 19 by Magistrate William M. Miller.
