The following citations have been recorded in the Tucker County Magistrate office:
- Jason P. Adams, Imperial, Pa., was cited for speeding (54-45) by Trp. J.E. Kopec. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Joshua Jessie White, Montrose, was cited for no seatbelt by Sgt. C.D. Siler. He pled no contest and was assessed fines of $25.
- Robert Scott Helmick, Knoxville, Md., was cited for no seatbelt by Sr. Trooper J.J. Schmidle. He pled guilty and was assessed fines of $25.
- Todd Brendan Elliott, Baltimore, Md., was cited for speeding (60-45) BY Sgt. C.D. Siler. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Karen A. Ballard, Fairfax, Va., was cited for speeding (54-45) by Sgt. J.E. Kopec. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- David S. Daft, Philippi, was cited for speeding (59-55) by Sr. Trp. J.J. Schmidle. He pled guilty and was assesses fines of $4.75 and court cost of $165.25.
- Matthew K. Whitehair, Davis, was cited for speeding (60-45) by Trp. J.E. Kopec. He pled guilty and was assessed fines of $4.75 and court cost of $165.25.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Nicole Marie Oliver, of Davis was charged with Driving Suspended Third offense. According to the criminal complaint, Trooper J.E. Kopec received information that Oliver was parked in the parking lot across from City Hall in Parsons and had a suspended driver’s license. Kopec observed her in the vehicle when he ran her license through Tucker 911, he found that her license was invalid with two prior suspended convictions. Kopec was parked at the State Police Detachment and observed the accused drive past with an expired registration. She was pulled over and arrested for driving suspended Third offense.
- Larry Wade Nestor, of Hendricks, was charged with malicious assault; battery. According to the criminal complaint, on June 24 an altercation occurred between Nestor, and Matthew L. Lipscomb. Allegedly, an argument began over the disappearance of Lipscomb’s dog. The defendant and Lipscomb are neighbors and both were in their own yards when the argument began. Words were exchanged resulting in Lipscomb going to the defendants’ fence. At this point a physical confrontation began between the defendant, his son Eric and Lipscomb. Allegedly, during this confrontation, Nestor’s wife, Virginia Rachel (Forbes) Nestor, held Lipscomb down while the defendant and his son struck him. Lipscomb had visible marks and swelling on his face and one finger was possibly broken.
- Virginia Rachel (Forbes) Nestor, of Hendricks, was charged with malicious assault; battery. According to the criminal complaint, on June 24 an altercation occurred between Nestor, and Matthew L. Lipscomb. Allegedly, an argument began over the disappearance of Lipscomb’s dog. The defendant and Lipscomb are neighbors and both were in their own yards when the argument began. Words were exchanged resulting in Lipscomb going to the defendants’ fence. At this point a physical confrontation began between the defendant, his son Eric and Lipscomb. During this confrontation the Nestor’s allegedly struck the victim with their fists several times. At some time during the confrontation, Eric Nestor’s wife, the defendant, came around the house to where the confrontation was taking place and allegedly held the victim down while both Larry Nestor and Eric Nestor struck him. Lipscomb had visible marks and swelling on his face and one finger was possibly broken.
- Clayton Matthew Carpenter, of Davis, has been charged with Domestic Battery. According to the criminal complaint, from May of 2014 through August 2014 The defendant did mentally and physically abuse Anna Janus of Davis. Allegedly, Carpenter called her vulgar names and physically abused her, holding a pillow over her face and pinching and twisting sensitive parts of her body. At one point the victim allegedly woke up to Carpenter having sex with her. She tried to push him away and told him to stop at which time he held her wrists but would not stop. He put his hand over her mouth to shut her up. He is under a $5,000 cash bond.

According to the criminal complaint, from May of 2014 through August 2014 The defendant did mentally and physically abuse Anna Janus of Davis. Allegedly, Carpenter called her vulgar names and physically abused her, holding a pillow over her face and pinching and twisting sensitive parts of her body. - Clayton Matthew Carpenter, of Davis, has been charged with Fraudulent Schemes. According to the criminal complaint, on Aug. 28 Trooper First Class J.J. Schmidle met with Phillip Zmijewske in regards to a fraudulent schemes complaint. The victim advised since the beginning of August he had been conversing with Clayton Carpenter regarding him finding a girlfriend for the victim for $100 finder fee. The victim allegedly paid the defendant and an alleged girl name “Kimmie” began to text the victim. Zmijewske advised that from the beginning of August till now, he has paid Carpenter approximately $2,000. This money was to enable “Kimmie” to visit. The victim believes the girl is not real and this is just Carpenter taking his money. The victim has never spoken to or seen this girl. The only communication has been through an application on his phone.
- Cade Joseph Archuleta, of Hendricks, was charged with DUI First offense. According to the criminal complaint, on Nov 1 a white pickup operated by the defendant was pulled over for speeding. A field sobriety test was administered and the defendant failed said tests. The defendant refused a breath test and was placed under arrest. Upon arrival at the Parsons Police Department the defendant refused to sign the Implied Consent Form as well as refused to submit to the intoxicator.
The following cases have been adjudged in the Tucker County Magistrate Court:
- Robert Douglas Sturtz, Jr., Cumberland, Md., received judgment of guilty verdict for one count speeding which occurred on Sept. 3. He was assessed fines of $100 and cost and fees of $165.25. Case was ordered and adjudged on Oct. 28 by Magistrate Riley H. Barb.
- Elena Spivey, Fairfax. Va., received judgment of guilty verdict for one count speeding which occurred on Aug. 20. She was assessed fines of $4.75 and cost and fees of $165.25. Case was ordered and adjudged on Oct. 21 by Magistrate Carol D. Irons.
- Amber Nicole Knotts, Parsons, received a guilty verdict for cell phone use while driving which occurred on Sept. 8. She was assessed fines of $100 with total due to court of $125. Ordered and adjudged on Oct. 21 by Magistrate Carol D. Irons.
- John Hunter Dix II, received a guilty-plea agreement for one count Driving under influence of any other drug on July, 4. He was assessed fines of $100, cost and fees of $240.25. He also received one day jail time and Day reporting for six months to Community Corrections. Total case balance was $510.25. Ordered and adjudged on Oct. 22 by Carol D. Irons.
