The following criminal complaints have been filed in the Tucker County Magistrate Court:
William Glen Murphy, Kerens, was charged with a felony count of Malicious Assault and Domestic Battery. The complaint states that on July 12 at approximately 10 p.m. Cpl. J.E. Kopec was dispatched to a domestic dispute in progress at the Overlook Trailer Park. When he arrived at the neighbors residence, Angela Eldridge was observed to have bruising on her neck, left wrist and blood droplets on her clothing and skin. Photographic evidence was taken. A one page hand written statement from Eldridge stated that she and Murphy allegedly got into an argument that evening at their residence in Overlook Trailer Park and it became physical. She stated that he allegedly punched her, threw her on the ground, kicked her and allegedly held a machete up to her neck all of which caused her pain. She stated that she escaped and walked to a neighbor’s residence who called 911. After obtaining her statement, Kopec traveled next door to the residence and arrested Murphy. Next to Murphy was a machete and he claimed it was his. The Tucker County Sheriff’s Department transported Murphy to the Parsons State Police Detachment for processing. Kopec and Eldridge traveled to her residence and Kopec took pictures of the scene which depict blood on the walls, the kitchen table flipped over, hack marks on the counter top, walls and furniture, blood droplets on the floor and the front driveway. In the living room a table was shoved over, a hole punched in the wall, the porch screen knocked out, hack marks on the front porch and multiple items strewn about the residence. Eldridge allegedly stated that she felt Murphy was going to kill her. Murphy was processed and transported to the Tygart Valley Regional Jail where he is under a $6,000 bond.
Ronald Dale Poling, Parsons, was charged with Driving Revoked for DUI. According to the complaint, on Saturday, July 9 at approximately 11:42 p.m. officers were dispatched to Mt. Zion Rd for a motor vehicle accident. Deputy B.T. Zirk and Cpl. D.W. Burge arrived on scene and observed a Ford pickup laying on the driver side and blocking the roadway. Burge obtained a written statement from the driver, Ronald Dale Poling. Tucker County Communications advised that the defendant has an active revocation on his operators for driving under the influence with an effective date of Oct. 21, 2015. He was arrested and transported for processing. He provided a statement that he was allegedly driving the vehicle when he lost control and wrecked. He was transported to the Tygart Valley Regional Jail and has posted a $500 bond.
Paul Philip Bircher, Elk Garden, was charged with Harassing Phone Calls or texts. On Wednesday, June 8, the victim, Heather Jackson, arrived at the Parsons State Police Detachment in reference to the suspect harassing her through text messages. A statement was taken that said the two had broken up one and a half weeks prior to the reporting of this incident. She stated that Bircher has been continually verbally abusive towards her and she repeatedly told him to stop calling and texting her. He allegedly called and texted a number of times over the next two days and all evidence was photographed by police. Bircher is free on a $1,000 bond.
Ami R. King, Charleston, was charged with writing worthless checks. The complaint states that she wrote checks totaling $309.72 at a local business. She is being held in the Tygart Valley Regional Jail.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
Schmitt verses Edwards was found in favor of Susan A. Schmitt, MD against Melissa and Richard Edwards in the amount $1.310.49 plus $110 court cost.
Smith verses Ramirez was found in favor of Morgan Joseph Smith against Paul Ramirez in the amount of $450 plus $75 court cost.
St. George Medical Clinic verses Donald Barkley found in favor of St George Medical Clinic in the amount of $263.44 plus $75 court cost.
State of West Virginia verses Nicole Marie Oliver, Davis, received judgment of guilty plea for one count DUI first offense which occurred on April 25. She was assessed fines of $100, court cost of $240.25 and jail for 48 hours. This case was heard on July 7 by Magistrate Riley H. Barb.
State of West Virginia verses Tori Knox, Mill Creek, received guilty plea agreement for one count aiding escape and other offenses relating to adults and juveniles which occurred on May 29. She was assessed court cost of $165.25; suspended jail term of three months; credit for time served on 40 days and unsupervised home confinement of 53 days. This case was heard on July 7 by Magistrate William M. Miller.
State of West Virginia verses Richard K. Henderson, Hambleton, received no contest plea for one count unsafe and improperly equipped vehicles which occurred on May 27. He was assessed fines of $4.75 and court cost of $165.75. The case was heard on July 11 by Magistrate William M. Miller.
State of West Virginia verses Christopher S. Earnest, Hambleton, received guilty plea for one count reckless driving which occurred on Dec. 26, 2015. He was assessed court cost of $165.25, suspended jail term of 40 hours plus community service of 40 hours. This case was heard on July 7 by Magistrate Riley H. Barb.
