The following criminal complaints have been filed in the Tucker County Magistrate office:
Brandon Lee Bryant, of Davis, was charged with one count Misdemeanor offenses for violation of protective order. According to the complaint on Monday, Jan. 22 Deputy C.R. Summerfiled of the Tucker County Sheriff’s office received a Domestic Violence Emergency Protective Order to be served on Brandon Lee Bryant in Thomas. He served the DVPO to Bryant in person at 6:15 p.m. and explained the terms therein.
On the same date at approximately 8:36 p.m. Summerfiled received a call from Tucker County 911 stating that Bryant had returned to the residence. Summerfield arrived on scene and was met at the front door by Bryant, who was inside. He was placed under arrest for violation of a DVPO and transported to the WVSP office in Hambleton for processing. Bryant was then transported to TVRJ to wait arraignment.
John Warren Wik, of Davis, was charged with driving under influence of alcohol and refusal to submit to tests. The complaint states that On Saturday, Jan. 20 at approximately 9:46 p.m. Trooper G.P. Hahn and Trooper C.A. Hawkins were dispatched via Tucker County 911 to a one vehicle MVC located at 1716 Cortland Rd, Davis. They were advised that a truck had struck the residence.
While en=route the officers were advised that Fire and EMS personnel on scene could smell alcohol on the driver’s breath.
When officers arrived on scene and made contact with the driver, they observed that he was in a mild state of confusion. They also detected the odor of alcohol on his breath. Wik advised officers that he had had one or two beers earlier in the evening.
Field sobriety tests were administered and Wik showed signs of impairment while performing. He was transported to Parsons Police Department and refused to take a secondary breath test. The fifteen minute waiting period was observed and again Wik refused to take the breath test.
A search warrant was obtained from Tucker County Magistrate B.K. Wilfong for probable cause and the officers traveled to Davis Medical Center where Wik was treated for injuries following the MVC and at this time the warrant was executed.
The above crimes occurred in Tucker County and all individuals are presumed innocent until proven otherwise in a court of law.
