The following criminal complaint has been filed in the Tucker County Clerk’s office:
William Cole Hutzler, of Belington, was charged with Possession with Intent. The complaint states that on Monday, Feb. 3, S/Trp. C.A. Hawkins was contacted by Sgt. J.M. Tallman of the Mountain Region Drug and Task Force in reference to a drug investigation involving the defendant, William Cole Hutzler. This investigation was in reference to the defendant receiving narcotics through the common mail carrier system. Tallman observed the defendant arrive and shortly leave the area in which common mail is delivered in Tucker County, specifically the Thomas area. Hawkins observed the defendant driving a Chevrolet Impala that had a loud exhaust and a defective passenger taillight. At this time, he initiated a traffic stop on Brown St. He made contact with the defendant and observed his motor vehicle inspection sticker to be expired in December 2024. He observed a mail package lying in the front floorboard area of the car.
Members of the Mountain Region Drug and Violent Crime Task Force arrived to assist in this investigation.
Upon second approach, Hawkins noticed the box had been moved from its previous location. First Sgt. J.S. Chumley informed Hawkins the box was already semi-opened and could see a vacuum-sealed plastic bag inside the box, which was now on the front passenger seat where the defendant had placed it. Tallman then requested the defendant out of the vehicle and he was detained at this time.
Members of the Task Force had informed Hawkins that they had already requested a K-9 to conduct a free air sniff around the vehicle.
Hawkins was writing citations to the defendant for Defective Equipment; Expired MVI, Obstructed View and Loud Exhaust, all of which were attached to this criminal complaint. While writing these citations, a K-9 with the Task Force arrived and performed a free-air sniff around the vehicle. This search resulted in a positive indication for the odor of controlled substances. At this time, a search was performed by Task Force members and the previously mentioned box had approximately one (1) pound of a crystal like substance believed to be methamphetamine. Hawkins arrested the defendant for Possession with Intent to Deliver Methamphetamine and he was transported to the Parsons Detachment for processing.
Zach Dorsey, of Berkley Springs, was charged with non-payment of rental fees in a state park, state forest or wildlife management area. According to the complaint on Dec. 19, 2024 Officer D.B. McFarlan was contacted by Dave Vance, the Recreation Manager at Canaan Valley State Park. He informed the office that Zach Dorsey of Berkley Springs had rented a campsite for the winter storage of his camper from Nov. 1 2024 too Jan. 1, 2025. Vance informed the officer that his office had made several attempts to collect payment from Dorsey, each time the transaction was declined by the credit card company. He had also tried to contact Dorsey by telephone, had left voicemails and Dorsey had not returned the calls. The total amount owed is $530 and the camper was removed from the site as of Dec. 18, 2024. McFarlan requests that Dorsey be summoned to appear for violating 58CSR31-2, (It is unlawful for any person not to pay the rental, charge or fee for any facility, service, activity or good he or she uses or purchases in a state park, state forest or state wildlife management area).
These crimes occurred in Tucker County and all individuals are presumed innocent until proven otherwise in a court of law.
