The following criminal complaints have been filed in the Tucker County Magistrate office:

Christopher Boone Gidley and Byron Zaine Gidley, both were charged with Cruelty to Animals. According to the complaint, on Monday, Sept. 22 Sgt B.T. Zirk of the Tucker County sheriff’s office received a complaint from Deputy Gidley who advised he received a call from Tucker County Animal Control Officer (ACO) Thompson regarding an animal neglect complaint. Deputy Gidley advised he and ACO Thompson responded to the scene. He stated they responded to the residence and observed the outside of the property to be in poorly kept condition. He advised he heard dogs barking inside the residence and upon looking, observed gray dog appearing to be in good condition. He said he observed the inside of the residence to be poorly kept as well, noting the residence was covered in feces. He stated h e spoke with the property/dog owner, identified as Christopher Gidley, and determined the dogs needed to be surrendered. Upon surrendering the dogs to the Tucker County Animal Shelter, Deputy Gidley advised a brown and white dog appeared to be in very poor condition. He stated these dogs were taken to a vet for further care. Sgt. Zirk received reports from Deputy Gidley and Tucker County Animal Shelter Director, Stacey Canfield. Both reports indicated the dog was infested with fleas, had discolored gums, appeared to have a greenish-white substance coming from its eyes and its skeletal system showing.
On Friday, Oct. 3 Sgt. Zirk and ACO Thompson met with Byron at the TCSO. Sgt. Zirk obtained a handwritten and signed statement from Byron. In summary, Byron stated there were three dogs, one was his and two were his fathers but he had since surrendered his to the shelter. He stated he was taking care of the dogs but did not have the time or money so he surrendered his and told his dad he would help when he could. He stated after surrendering his dog he continued to go to the house and would do so while he was coming to or coming from work and he would go every day or every other day. He said he would feed them individually and then leave the bag open in case they wanted more. When asked if his father would go to the house any, he stated he did not know, they did not talk much. He further stated he noticed the condition of the dog he could see it was getting skinny and he would try to feed it more but it did not help, when he to his dog to the shelter, he told them he wanted them to take his fathers dog too, he was told they did not have room. He further stated he told his father about the dog and he advised he would take care of it.
On Friday, Oct. 3, Zirk and Thompson met with Christopher Gidley at the TCSO and Zirk read and explained D.P.S. Form 79 (Interview and Miranda Rights form) to Christopher to which he advised he understood and agreed to make a statement. During this interview, he acknowledged that they were his dogs and his responsibility, but he thought his son Byron, was taking care of the dogs.
Sgt. Zirk and Sheriff Kopec spoke with Director Canfield who advised when the dog was surrendered on Sept 22, it weighed approximately 46.8 pounds and as of Oct. 13 the dog weighed approximately 68 pounds. Director Canfield also advised the dog was placed on an iron supplement due to being anemic from flea infestation.
These crimes occurred in Tucker County and all individuals are presumed innocent until proven otherwise in a court of law.
