The following criminal complaint has been filed in the Tucker County Clerk’s office:
David Sidney Berry, of Thomas, was charged with 3 counts of Assault, one count of Obstructing an Officer and one count of Failure to Fingerprint. According to the complaint on Monday, March 25 Trooper G.P. Hahn was dispatched t for a call of a domestic. He arrived on scene and was met by the victim. The trooper was advised that the defendant had allegedly threatened to stab the victim with a screwdriver. He was also advised that an HVAC crew had also been at the residence and were allegedly threatened to be stabbed by the defendant as well.
The officer made contact with the defendant who admitted to threatening the victims. Hahn attempted to resolve the situation by getting the defendant to leave for the night to which he became belligerent. The officer located the HVAC crew who had been at the residence and spoke with them. They advised Hahn that the accused allegedly threatened to stab both of them in the eyes with a screwdriver and was very belligerent which made them fear for their safety so they left the residence.
On the same date Hahn attempted to serve a warrant on the defendant at the above address. When he arrived on scene and announced himself he could hear the defendant inside the residence being belligerent and refused to come outside. Hahn made entry and once inside the defendant was placed into custody. While attempting to take him to the patrol vehicle he began to resist and not comply with commands given to him. He was transported to the Tygart Valley Regional Jail where he refused to submit his fingerprints via Live Scan.
