The following criminal complaints have been filed in the Tucker County Magistrate office:
Diane Lantz Johnson: of Davis, was charged with one felony count of Burglary and one felony count Assault during commission of or attempt to commit a felony and a separate misdemeanor charge of Domestic Battery. On Friday, June 14 Trooper G.P. Hahn took a call through Tucker 911 of a domestic at the Arnold Park campground. He arrived on scene and was met by the victim and his girlfriend, who were outside his camper. Hahn asked what happened and was advised that his ex-girlfriend, the defendant, had driven into his camp area and allegedly began beating on the window of the camper and screaming profanities.
Hahn observed what appeared to be palm prints on the window of the camper next to the door. He was then advised that the suspect allegedly “ripped” the door of the camper open and entered to gain access to the victims inside. He was then advised that the suspect allegedly threatened to kill the female victim when the make victim got between them. Hahn was then advised that the suspect allegedly struck the male victim in the face two times before exiting the camper. Hahn observed the area that was said to have been struck and located a minor swelling and redness.
Hahn also spoke with an observer who was in a neighboring camper and was advised that the suspect had arrived earlier in the day as well asking the whereabouts of the two victims. Hahn was then advised that when the suspect returned at the time of the incident, she was erratic and belligerent. Hahn was told she had driven off the road and over a pile of rocks before banging on and entering said camper. Hahn was told that when the suspect heard that law enforcement was en-route she quickly fled the scene and again ran over the pile of rocks. Hahn did observe fresh tire marks through the yard where the camper is located and markings on a large pile of rocks that appeared to have been run over.
Marshall Dwaine Parsons: of Parsons, was charged with one count of Driving while license suspended or revoked – Second Offense, one count Reckless Driving and one count Obedience to traffic control devices. The complaint states that on Thursday, June 13 at approximately 7:10 p.m. Trooper R.S. Musgrave was conducting a routine patrol on Central Ave in Parsons. At this time, he observed a black F250 traveling at a high rate of speed through a residential area and failed to stop at a stop sign. Through previous Law Enforcement experiences, Musgrave knew the owner of the truck to be Marshall Parsons.
At this time he conducted a traffic stop and Parsons was subsequently identified as the driver. At this time WVSP Elkins Communications advised Musgrave that the suspect’s license was Suspended/Revoked. After running the suspect’s information Musgrave acknowledged a previous conviction for driving revoked for DUI, making this incident the suspect’s second offense.
Musgrave places Parsons under arrest for driving revoked for DUI and then transported him to the WVSP Parsons Detachment where he was processed. He was then transported to TVRJ where he was remanded into the custody of Division of Corrections.
Eric S. Pennington: of Parsons, was charged with one count Possession of Controlled Substance (Marijuana), one count Destruction of Property, one count Harassment and one count of Trespassing. According to the complaint, on Thursday, May 30 at approximately 2:55 a.m., Tucker 911 Communications contacted Elkins Communication in regard to a 911 call. The caller advised 911 operators that her ex-boyfriend, Eric Pennington, had showed up at the residence and was allegedly banging on her bedroom window. A brief conversation between the two was conducted and the defendant was asked to leave according to the complainant. The complainant advised that the defendant had advised he wanted to talk to her about failing a drug test and possibly going to jail. During the time the defendant was on the property, a potted plant was destroyed in the driveway, an electric fence charger was pulled from its mount and thrown in the yard and a utility trailer was pulled across the driveway to which eliminated access by vehicle to the home.
Upon arrival Sgt. V.J. Pyles observed a destroyed potted plant, fence charger and a utility trailer blocking the driveway. The complainant advised she had several children in the home at the time of the incident. The complainant advised that the defendant, whom she is familiar with, and had a previous relationship with, had left his flashlight and a small amount of marijuana by her bedroom window. The item were observed in the said location and collected by Pyles.
Charges in summary:
- The defendant destroyed a potted plant and removed property (fence charger) causing possible damage.
- The property is posted and the defendant was unwanted on the property.
- The complainant felt as if she was being harassed by the defendant after their relationship was ended by the defendant coming to the property and refusing to leave.
- The defendant left his flashlight on the property along with a bag of marijuana. The defendant is on probation and subject to drug testing.
All acts occurred in Tucker County.
