The following criminal complaints have been foiled in the Tucker County Magistrate office:
James Wilfong, was charged with one felony count of Grand Larceny. According to the complaint on Monday, Nov. 11 Cpl. C.R. Summerfield of the Tucker County Sheriff’s’ office (TCSO) received a complaint about a stolen ATV from Brown St. in Thomas.
On Friday, Nov 15 Sheriff J.E. Kopec met with the victim at the TCSO and obtained a handwritten and signed statement from her. In summary, she stated that on Thursday, Nov 7 at approximately 9 a.m. they were out of town for a family emergency. The following Monday their neighbor called and told them that the red Redcat 250 was stolen. She stated that she believes that James Wilfong allegedly stole the ATV because a juvenile told her that it was at his house. And also stated that the ATV is worth approximately $3,500 and described zip ties in the right fender and the red Acerbis hand guards. She provided Sgt. Zirk with photos of the ATV along with Snapchat messages containing information regarding this case.
On Wednesday, Nov. 20 Cpl. Summerfield obtained information that the ATV was observed in a field below Wilfong’s residence in Douglas. From Snyder Run Road, Cpl. Summerfield observed what appeared to be red ATV plastics. Upon walking through the field, that was discovered to be owned by Western Pocahontas (Mountain Top Hunting Club), Summerfield located four ATV tires along with red plastics containing black zip ties in the right fender. All parts discovered matched photos that were provided of the ATV.
On Thursday, Nov. 21 Summerfield and Zirk met with the juvenile and his parents at the TCSO after reading the juvenile Interview and Miranda Right (WVSP Form 79-A) that all parties agreed to and signed, Summerfield obtained a digital voice recorded audio statement. In summary the juvenile stated that he talked to Wilfong on Sunday, Nov. 10 and he asked him about wanting to steal a bike. Later that day the juvenile text him and told him that he wanted to do it. They communicated by Snapchat messages throughout the day. The juvenile stated that himself, Wilfong and Wilfong’s girlfriend, Samantha Armstrong stole the ATV. They hotwired it and drove it to the woods near Wilfong’s residence. They walked to the residence and allegedly consumed Fireball and marijuana. The juvenile stated that Armstrong and Wilfong bought him the Cloud 8 disposable from the gas station in Thomas. Approximately 30 minutes they returned to the ATV and Wilfong drove it to the field below his house. The next day (Monday morning) the juvenile returned to the ATV along with Wilfong and Armstrong to take the ATV apart. He stated that they allegedly removed the plastics, handlebars, hand guards, shocks, A-arms, tires, air box and battery. The juvenile stated that they hid the parts in the field. Wilfong took the gas tank and the battery to his residence and placed them on a trailer behind his house.
