The following criminal complaints have been filed in the Tucker County Magistrate office:
WENDALL ALLEN MORGAN, of Keyser, was charged with one count of Persons prohibited from possessing firearms. According to the complaint, on Saturday, June 22, Deputy C.R. Summerfield of the Tucker County sheriff’s Office (TCSO) was patrolling WV32 in Canaan when he observed a vehicle fail to obey a traffic control device. He initiated a traffic stop and the driver stated that he did not have his wallet with him but stated that his name was Wendall Morgan.
Trooper G.P. Hahn of the West Virginia State Police arrived on scene and both officers observed a marijuana smoking device on the passenger seat. Morgan stated that he smoked marijuana before leaving his residence. Deputy Summerfield administered a series of field sobriety tests and Morgan showed no sign of impairment. While conducting a search of the vehicle Morgan stated that there was a handgun under the driver’s side floor mat. Officers located a Taurus TCP 380 ACP concealed under the mat. They also located additional marijuana smoking devices, containers and baggies containing a green leafy substance that is consistent with marijuana
Summerfield contacted Tucker County 911 and provided name and date of birth of Morgan and was advised that his right of drive a motor vehicle was suspended. After further investigation it was discovered that he was prohibited from possessing a firearm due to previous felony charges.
SETH T. WILES, of Aurora, was charged with one count Aggravated DUI,
One count Expired registration and one count no proof of insurance. The complaint states that on Wednesday, May 1 at approximately 1:40 a.m. Officer Victor Pyles was contacted by WVSP Elkins Communications regarding a night call from Tucker 911. The call was regarding a single vehicle collision which was said to have occurred on WV32 at or near Springhouse Road. Pyles was advised that the driver was possibly intoxicated and was injured. At 2:19 a.m. Pyles arrived on scene and began the crash investigation. The driver, who was being treated by EMS and ready for transport, was identified as Seth T. Wiles. Pyles gained a statement from the defendant that he must have fallen asleep and was attempting to drive home from work. He further states that he had 4 beers at Mama Mia’s prior to the accident. Pyles could detect the odor of an alcoholic beverage at the time of initial contact. Due to injuries, no field sobriety tests could be administered. He was transported to DMC for treatment.
A registration inquiry through Elkins Communications advised that the registration was expired as of 7-2022. The officer spoke with Mrs. Wiles who stated she would provide insurance for the vehicle which she never did and no insurance information was inside the vehicle.
Upon arriving at DMC the defendant was asked to supply blood for a CDDP Blood Kit to determine BAC. He agreed and a blood draw affidavit was filled out along with consent in the CDDP kit. Said kit was sent to WVSP Laboratory for toxicology. On May 29, the officer received the results of said blood test which showed the defendant had a BAC of .204.
The defendant was found to have a BAC of .15 or above justifying the charge of Aggravated DUI. The vehicle has expired registration justifying the charge of expired registration and the defendant/vehicle owners, have failed to provide proof of insurance justifying the charge of no proof of insurance.
JASON WILLIAM HEBB, of Harman, was charged with one count of Driving under influence of alcohol, controlled substances or drugs. According to the complaint, on Saturday, March 23 Deputy C.R. Summerfield of the Tucker County Sheriff’s Office was dispatched to a multiple vehicle crash located on US 219 near Parsons. When he arrived on scene, he discovered a male subject, namely Jason William Hebb, and he appeared to be impaired. He was allegedly falling backwards into a ditch and his speech was slurred. Upon further investigation it was determined that Hebb had crossed the center line and struck 2 vehicles. Field sobriety tests were administered and Hebb failed them all.
Summerfield obtained a search warrant for the defendant’s blood and said warrant was executed at DMC. A CDDP blood kit was used and sent to WVSP Forensic Lab for examination. Summerfield received the results from the blood kit and discovered that alprazolam, amphetamine, fentanyl, methamphetamine and norfentanyl were confirmed to be present.
Summerfield initiated a follow up telephone call with the other drivers involved in the crash and was provided with medical records from DMC. One driver sustained acute cervical strain and mild gross closed head injury and the other driver had bruising to the area of the abdomen where the lap belt lays along with a seat belt burn to the right side of the neck.
KELLY LYNN PENNINGTON, of Parsons, was charged with one count Domestic battery. The complaint states that on Thursday, June 27 at approximately 6:35 p.m., Tucker County 911 Communications dispatched any available Law Enforcement for a domestic in progress at 101 Price Street. Patrolman First Class N.C. Gidley, Trooper G.P. Hahn and Deputy B.M. Gidley advised they would be en-route to that location. Tucker 911 advised that the altercation had been physical in nature.
PFC. Gidley and Trooper Hahn arrived on scene at approximately 6:37 p.m. Gidley spoke with the victim who, in summary, stated that he had arrived at the residence to obtain some of his belongings and an argument began between him and the defendant. He stated that they argued as he went into the bedroom of the residence and as he bent down to get some belongings, she began striking him in the face. He advised she allegedly struck him with a closed fist and he attempted to shield himself by putting his hands up near his head. Pfc. Gidley observed blood on the right side of the victim’s mouth. A mark was observed on the left side of the victim’s neck by Trooper Hahn and Pfc. Gidley.
Pfc. Gidley spoke with a witness who observed the incident and they stated that the victim and the defendant were having a verbal argument after the victim arrived to retrieve some of his belongings. The witness stated that when both individuals went into the bedroom, he went upstairs and immediately came back down. The witness stated that as he turned into the bedroom he observed the defendant striking the victim multiple times in the head. The witness stated that the victim had his hands up attempting to stop the strikes.
Pennington was placed into custody by Pfc. Gidley for Domestic battery. She was then transported to the WVSP Barracks by Trooper Hahn for processing and then to the Parsons Police Department to await arrival of the on-call Magistrate for arraignment.
All the above crimes took place in Tucker County and all individuals are presumed innocent until proven otherwise in a court of law.
