Annual Burning Law Restrictions In Force

Beginning October 1 until December 31, fires may only be burned between 5 p.m. and 7 a.m. There can be no burning from 7 a.m. until 5 p.m. and all fires must be attended at all times. Fire areas must be cleared down to mineral soil for a minimum distance of 10 feet around what is being burned. If a fire escapes, the individual is liable for the costs of the fighting of the fire and any damages caused to others.

Willfully setting a fire is a felony and punishable by a fine and/or imprisonment. Maximum Fine 1,000 for violating the Burning Law. WV Arson Hotline 1-800-233-FIRE. All information supplied by the WV Division of Forestry, WV Forestry Association and U.S. Forest Service.

Parsons Fire Department Fire Chief Kevin White reminds citizens that no man made materials can ever be burned in West Virginia. Only natural materials such as wood, leaves and lawn debris can be burned under the Burn Law.
