Clayton Mallow appeared before Judge Courrier in Circuit Court October 15th to accept a plea deal in which he plead guilty to five felony counts of fraudulent use of an access device. With the guilty plea, all other charges were dismissed.
Mallow appeared in court with his attorney James Fox. Tucker County Prosecuting Attorney Savannah Hull Wilkins represented the State in the matter.
Wilkins asked that Mallow forfeit all interest in seized items, as well as pay restitution. Wilkins also asked the court for concurrent two year sentences to run concurrent with any sentences to come from the ongoing cases in Randolph County to be served as home confinement and due to the sexually motivated nature of the crime, requested that Mallow be required to register on the sex offender registry.
Mallow was sworn in and said he understood the agreement and understood that he faced a possible 10 year sentence per count by State statute. Mallow also said he was satisfied with his representation and understood the options, but entered into the agreement voluntarily.
Judge Courrier explained that if Mallow is found at sentencing to be required to register as a sex offender, what his requirements will be, as well as the ongoing requirements.
Both Wilkins and Fox agreed on the facts of the case that Mallow had been employed by a insurance agency in Parsons where he used client account information to make purchases and attempted purchases.
A written guilty plea was entered in court. Sentencing is scheduled for next month.
