The following criminal complaint has been filed in the Tucker County Magistrate office:

• Charles E. Likens II, of Thomas, was charged with one count of Aggravated DUI (1sr Offense). The complaint states that on Thursday, Jan. 1 at approximately 2:30 a.m., Sr. Trooper R.S. Musgrave was dispatched by WVSP Communication for a welfare check on US219 near the sand plant in Thomas. He was advised there was a male subject passed out and unresponsive in his vehicle in the middle of the roadway.

At approximately 3:13 a.m. Musgrave arrived on scene and observed a gray vehicle stopped in the wrong lane of travel. He made contact with the driver and acknowledged the odor of alcohol emanating from the driver. He also observed glassy red eyes and slow/slurred speech. At this time the driver was identified as Charles Likens.

Field sobriety tests were conducted and was failed by Likens. He also failed to perform the Preliminary Breath Test correctly. At this time Likens was placed under arrest for DUI based on his performance throughout the tests, he was transported to Parsons Police Department for the Intox.

Musgrave explained the implied consent form to which Likens understood and signed. A secondary test (Intox) was issued and after the test his BAC was .235%. Musgrave read Likens his Miranda Rights to which he agreed to answer questions. Likens openly admitted to drinking multiple drinks prior to operating a motor vehicle. At this time, he was transported to the WVSP Parsons Detachment to be processed and LiveScanned.

• Jefferson L. Tripplett, Special Commissioner, Black Fork District, Quick Claim Deed, 2.2 acres to Allan Arthur Scott and Melissa Swan Scott.

• Robert A. Borowitz and Melissa Squillaro Borowitz, Davis Corporation, Part Lot B, William Ave to Allegheny Mountain Adventures LLC, %25,000.

• JGS LLC, Davis Corporation, Lot 96, Henry Ave to Brian Sarfino., $57,500.

• SCB Properties, Christal G. Perr, Appointee of the Honorable Mark Hunt, Mark Hunt, State Auditor, Davis Corporation, Tax Lein Sale-Lot 107, phase a, 0.55 acres, Tuscan Ridge to Gold Enterprises LLC, $427.06.

• James R. Vance, Dry Fork District, Confirmatory Deed, 0.99 acres, Laneville Parcel A – House/Parcel B – Garage to James R. Vance.

• Lee O. Miller, Jonah Miller and Zachery Miller, Dry Fork District, Tract 9, 2.01 acres, Black Bear Wood Sub-division to Lee O. Miller.

• John D. Hambrick, Dry Fork District, 4.91 acres to Brian Sarfino and Taira Gainer, $625,000.

• Raptor Ridge Ventures LLC, Dry Fork District, Lot 56 Winterset to Collin Brown and Larissa Brown, $170,000.

• John D. Hambrick, Dry Fork District, 3 acres to Thoedore J. Fries, $325,000.

• Robert C. Hill and Diana Hill, Dry Fork District, Lot 19 Spruce Glades, 5.02 acres to Billy Atkinis and Carolyn P. Atkins, $100,000.

• Lee Hansroth, Christal G. Perry, Appointee of the Honorable Mark A. Hunt, Mark A. Hunt, State Auditor, Dry Fork District, Tax Lein Sale – 1/24 mineral/coal, 1900 Canaan, $170.26.

• Cindy Duckworth, Joseph Owens, Arnold Bruce Owens and Patricia Bailey, Licking District, Part of Parcel 7 being 82.45 acres to Arnold Bruce Owens and Shasta M. Owens.
