The following criminal complaints have been filed in the Tucker County Magistrate office:
Brandon Tyler Streets, of Parsons, was charged with two counts of Child Neglect with Risk of Injury. According to the complaint, on Sunday, April 14 at approximately 7:47 a.m. Sheriff J.E. Kopec was traveling along WV72 in front of the Annex when he was flagged down by off duty Parsons PD Chief Keplinger. Kopec pulled over and was informed by Keplinger that he was traveling to church when he found two young children in the roadway on the double yellow line. The children appeared to be about four years old. Kopec noticed one of the boys was in his boxer under-wear and an unzipped hooded shirt with no t-shirt. He asked the boys what they were doing and they said they were going to the park. They were cold so Kopec put them in his vehicle to warm them up and keep them safe.
Kopec contacted 911 to see if they had the boys’ parent’s names in their system, in an attempt to locate them. He then attempted to find their home by driving around the Parsons vicinity going off their direction, which was skewed at best. The boys did not have the best speech or knowledge of where their home was. This went on for 40 minutes until Kopec overheard one of the boys talking with his brother and state “Big Sam”. He asked the boy what he meant and he said, “Big Sam with the Big Truck.” Kopec knew of a Big Sam and called Sam Humphrey, who owns an apartment complex along Smokey Hollow Road. He informed Kopec the boys’ father rents from him in the apartment complex.
He then brought the boys to a residence at the apartment complex and they took him to an apartment where the front door was wide open. The boys walked in and Kopec asked them to go get their dad. Kopec talked to the father, identified as Brandon Tyler Streets, outside.
Streets informed Kopec that he had a long night that he had to go out to pick someone up at 2 a.m. and had recently worked a long shift. Streets informed Kopec that this had happened about a week ago and a neighbor brought the boys back that time. The boys were left in care and custody of their father because it was his visitation time. The children were .2 miles from their residence.
After informing the Ticker County Prosecutor of the incident it was decided charges would be presented due to neglect and danger the two children were in. The fact they were found in the center of a busy lined road where they could easily have been run over by a vehicle and unaccounted for for at least 40 minutes with no call to 911, no searching parent is what appears to be neglectful in the welfare of the two boys. The children’s age is another factor in this complaint at 4 ½ years old.
Timothy Wayne Myers, of Parsons, was charged with one felony count of intent to manufacture, deliver, or possess a controlled substance. On Sunday, April 7, Deputy C.R. Summerfield of the Tucker County Sheriff’s office was dispatched by Tucker County 911. 911 advised that an individual showed up at the caller’s residence to buy a light bar and a crossbow. Before leaving the individual left a bag of meth in the shed. Summerfield and Senior Trooper C.A. Hawkins of the WVSP arrived on scene and were met by the caller and her husband. They directed officers to the shed and they discovered a clear plastic bag on top of a red toolbox. The bag contained a crystal substance that is consistent with methamphetamine. Summerfield obtained photographic evidence of the scene and seized the substance. Officers tested the substance with a Mobile Detect field test kit and results revealed that the substance tested positive for methamphetamine.
While talking to the husband, he stated that after calling 911 Mr. Myers called him saying that he heard what was going on from the scanner and the caller stated that Myers allegedly told him to flush the substance and get rid of it. The caller showed the officers where Myers had called his phone. Summerfield obtained a digital voice recorded audio statement from the caller and in summary he stated that Myers called him wanting to buy his crossbow and light bar for a truck. Myers took the items and the caller walked back onto his porch. Myers then allegedly came onto the porch to see if the caller had a tire tool and he was told it was in the shed. Myers retrieved the tool and got into his truck and left. The caller stated he began looking around because he didn’t receive the cash for the items he was selling. When he returned to the shed he found a bag of meth on his toolbox.
On the same date Summerfield obtained a digital voice recorded audio statement from the wife. In summary she stated she was in the house and she received a notification on her home security camera that someone was there. When she looked at the camera she observed her husband talking to someone. She stated she observed Myers take the light bar from the shed. After the individual left she walked outside to ask her husband what was going on. She stated her husband told her he had sold his crossbow and light bar for $150. When she questioned her husband about the money for the items, he stated he didn’t know the individual had left. They walked to the shed to look for the money because that was the last place the man was. While looking in the shed for the money she stated she discovered the bag of meth on the toolbox. She stated she has home security camera that face toward the shed.
Summerfield requested to view the cameras and observed a male subject, Timothy Myers, talking to the husband outside the residence. Myers put a crossbow into a vehicle, and was observed walking toward the shed where the substance was located, out of the camera’s view.
These crimes occurred in Tucker County and all individuals are presumed to be innocent until proven otherwise in a court of law.
