In a status hearing held February 18th before Judge Steven L. Shaffer at the Tucker County Courthouse, Brian Quattro appeared in court with his newly appointed attorney John Rogers. Rogers said he was appointed following a motion filed by attorney Sam Hess, withdrawing as counsel for Quattro.
The hearing was initially set to be a plea hearing, but that was canceled due to the change in counsel. Rogers said that both sides were close to an agreement, but needed to time to finalize what the defense intends to do.
On the recommendation of Rogers, the case malicious assault case was set for trial May 20th to 22nd. The second case, intimidation of a Public Official, was set as a two day trial July 30th and 31st.
There was no pretrials set in the cases and any motions were requested by Judge Shaffer to be submitted by attorneys no later than one week prior to trial.
Judge Shaffer also explained to Quattro his trial rights during the hearing, as it would likely be the last time he would see the defendant prior to the day of trial.
