PARSONS – A Thomas man pleaded guilty to one count of burglary in Tucker County Circuit Court. Terick Hays, 32, appeared with his attorney, Timothy Gentilozzi before Tucker County Circuit Judge Philip B. Jordan Jr.
Tucker County Prosecuting Attorney Ray LaMora said the state offered to dismiss count two of the indictment if Hays agreed to pay restitution in the amount of $1,374.33 for items that were not able to be recovered.
Jordan ordered Hays removed from house arrest so the money could be used toward restitution. He ordered Hays to serve 18 months of probation, as long as the restitution and court costs were paid.
Also in Tucker County Circuit Court:
-Jordan denied a motion for a change of venue for Kenneth Bott. Bott’s attorney, Brett Easton argued for a change of venue in the case alleging Bott failed to pay hotel/motel tax.
-A hearing was continued for Brian Craft, 38, of Davis. Craft was charged with one count of sexual abuse in the first degree and child abuse with risk of injury.
-Deana Bates Clarke, 42, of Parsons, pleaded guilty to an information of intimidation of a state witness. Clarke appeared with her attorney, Gentilozzi. LaMora recommended time served for Clarke.
-Leonard Wilson, of Parsons, appeared with his attorney Tim Prentice. Wilson was charged with 10 counts of 3rd degree sexual assault, two counts of 2nd degree sexual assault and one count of contributing to the delinquency of a minor.
Prentice said Wilson asked for an attorney and did not receive an attorney. He said after reviewing Wilson’s taped interview, he felt his client did not want to answer any more questions. “We are alleging there are two violations of Mr. Wilson’s rights, at least two on this recording,” Prentice said. “I feel the recordings should be suppressed.”
LaMora said he did not have the same interpretation of the taped interview.
Jordan said he would look over the motion and review the interview before the next hearing.
-Jordan ordered a capias warrant for Ronald James. James did not appear at arraignment or his most recent hearing.
-A plea agreement was entered by Dale Ross. Ross appeared with his attorney Prentice.
LaMora said Ross pleaded guilty to one count of felony possession of a firearm. “The State recommends a sentence of two years, suspended for two years of probation,” LaMora said.
Jordan accepted Ross’ plea and sentenced Ross to five years, suspended, five years, suspended, for two years of probation.
