The following citations have been recorded in the Tucker County Magistrate office:
- Ernest L. Myers, Montrose, was cited for speeding (64-55) by Sgt. C.D. Siler. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
- Stephanie N. Lanham, Fairmont, was cited for expired MVI by Cpl. D.W. Burge. The charge was dismissed with proof shown.
- Susan H. Plum, Parsons, was cited for expired MVI by Cpl. D.W. Burge. She pled no contest and was assessed fines of $4.75 and court cost of $165.25.
The following criminal complaints have been filed in the Tucker County Magistrate Court:
- Hilde Mae Williams, Elkins, was charged with False Reporting an Emergency and False Information to Trooper. According to the complaint, on Tuesday, Jan. 2 at approximately 9 a.m. Sgt. C.D. Siler and TFC J.J. Schmidle received a phone call from WVSP Elkins Communications and Tucker County 911 in reference to a female being held at gun point against her will. Troopers responded to 29 Nestor Hollow Rd, Parsons, and located the victim identified as Hilde M. Williams and the suspect identified as Dustin Bruce Moran outside. Williams advised that Moran woke up and said he was missing money. He started yelling at her and told her she wasn’t going to leave the house until his money was returned. She told him she didn’t take his money and didn’t know anything about it. She advised he allegedly pushed her back on the bed, climbed on top of her allegedly yelling he was going to kill her, her family and kids. He went to the closet and pulled a pistol. She called her sister but the phone died and she tried to run from the apartment but he chased her down and told her to get in the car. He allegedly told her if she tried to run again he would break her legs. They traveled to the antique store in Parsons and he inquired if anyone there had been in his apartment. They traveled back to the apartment and he told her to stay in the car. She stated he allegedly grabbed his pistol out of the car and went in to meet two of his friends. He allegedly told her the only way she was leaving was in a body bag if he did not get his money. She also stated that he allegedly told her if she tried to run he would shoot her. On Tuesday, Feb. 27 TFC J.J. Schmidle was provided with an audio recording by the Tucker County Prosecutor, R. LaMora. This recording was obtained via voice mail from Dustin Moran’s phone and provided to LaMora by Moran’s attorney. The recording is of the alleged victim, Hilde M. Williams stating she lied about Moran holding her against her will and she just got caught up in the moment. In the recording she further advised she would contact WVSP Parsons Detachment and advised of her false reporting. She posted a$700 PR bond and a pre-trial hearing is scheduled for June 12 at 10 a.m. before Magistrate William M. Miller.
- Virgil Licugas Didawick, Elk Garden, was charged with Driving under the Influence of Alcohol, controlled substances or drugs and Driving while license Suspended or Revoked. According to the complaint on Monday, April 9 at approximately 11:15 a.m. Deputy B.T. Zirk of the Tucker County Sheriff’s Office was conducting a patrol near the intersection of WV32 and US219. He observed a black car traveling north through the intersection and continue to travel north on US 219. The vehicle did not have an MVI sticker and he initiated a traffic stop on the vehicle. When he ran the suspect’s license it came back as revoked for driving under the influence with an effective date of Nov. 16, 2016. Zirk asked the defendant to exit the vehicle and he noticed the odor of alcohol on his breath. He appeared to struggle and was unsteady on his feet. Zirk asked if he had anything to drink and he allegedly stated he had two or three beers about an hour ago and a sip of liquor about ten minutes before being pulled over. He agreed to and failed the field sobriety tests and the preliminary breath test read .199. He was placed under arrest and two mini liquor bottles were found in his coat pocket with one appearing to have been opened. Multiple opened alcoholic beverage containers were found in the vehicle. He was transported to the Parsons Police Department for processing. He was then transported to the Tygart Valley Regional Jail. He posted a $3,000 PR bond and a Bench Trial is scheduled for July 5 and 10:30 a.m. before Magistrate Riley H. Barb.
- Nicholas Gardner Steelhammer, Davis, was charged with DUI Second offense and Driving Revoked for DUI. The complaint states that on Thursday, April 4 at approximately 10:42 p.m. Cpl. D.W. Burge observed a Jeep Wrangler traveling north on WV32 at 47 mph in a 25 mph zone in Davis. He initiated a traffic stop and asked the defendant for his driver’s license, insurance card and registration card. Open alcoholic beverage containers were observed in the vehicle and the odor of alcohol was on the defendant’s breath. When speaking the defendant’s speech was slurred and eyes were glassy. Burge obtained a WV ID card and a WV registration card for the vehicle. When asked for his driver’s license he advised he did not have a valid license due to being revoked for DUI. He was asked for his insurance card and he allegedly advised he did not currently have insurance on the vehicle. He was asked if he had been drinking and he allegedly advised he had a couple beers. He was asked to exit the vehicle and perform field sobriety tests which he failed. He was arrested and transported to the Parsons Police Department where a secondary breath test was conducted which registered .103 BAC. He posted a $6,000 property/surety bond and a Bench Trial is scheduled for June 18 at 11 a.m. before Magistrate Riley H. Barb.
The following cases have been ordered and adjudged in the Tucker County Magistrate Court:
- State of West Virginia verses Ryan Deann Lower: Preliminary hearing was waived for one count manufacture/deliver/possess with intent to manufacture/deliver (Schedule I or II Narcotic) which occurred on March 24. This case was bound over to Tucker County Circuit Court. This case was heard on April 6 by Magistrate William M. Miller.
- St. George Dental Clinic verses Mason: This case was dismissed against Raymond R. Mason, all parties settled. This case was heard on April 6 by Magistrate William M. Miller.
- St. George Dental Clinic verses Gould: The court found in favor of the St. George Dental Clinic against Angela Gould in the amount of $141 plus $75 court cost. This case was heard on April 6 by Magistrate William M. Miller.
- State of West Virginia verses Kathy Eleanor Hawes: She received judgment of no contest plea for two counts making, issuing worthless checks which occurred on Oct. 28, 2017. She was assessed cost and fees of $380.50 and restitution of $44.15. This case was heard on April 4 by Magistrate William M. Miller.
