The following criminal complaint has been filed in the Tucker County Magistrate office:
Justin Clark Mallow, of Coalton, was charged with one count of Sexual Abuse 1st Degree. According to the complaint on Saturday, May 7 at approximately 4:46 p.m. Trooper C.A. Hawkins took a complaint of sexual abuse from Kimberly Shaffer. She stated that earlier that day her daughter disclosed to her that the defendant had inappropriately touched her when she was ten years old. Shaffer stated that Mallow had been living with them at the time of the incident which occurred in the bedroom of the residence.
On Monday, May 23 Hawkins attended a CAC interview conducted with the victim. During this interview the victim disclosed that Mallow would make comments to her that he loved her and that he liked her more than her mom. She also stated that Mallow would place his hand on her thigh and wrap his arms around her waist. She said that he came into her room one night and asked her for a goodnight kiss and she gave him one on the forehead. She said that he left and then came back again and asked for a kiss on the lips. She said she told him no, but he kissed her on the lips anyway, put his tongue in her mouth and said, “goodnight baby girl”, before leaving her room. She further advised that the final time he came into her room he touched her. When she was asked to identify where she had been touched, she pointed to her (private) area. She then identified the (private) area on a diagram of a girl. She advised she was wearing pajamas during the incident and he touched her outside of the clothes.
All suspects are presumed innocent until proven otherwise in a court of law.
