The following criminal complaints have been filed in the Tucker County Magistrate Office:
Roy A. Tuesing, Jr., of Hambleton, was charged with one count of Cruelty to Animals. According to the complaint, Sgt. B.T. Zirk, of the Tucker County Sheriff’s Office (TCSO) received a complaint of animal neglect from Animal Control Officer Thompson who provided him with a copy of his Incident Reports and a copy of a “Patient History Report” from Wild and Wonderful Veterinary Services.
According to Thompson’s Incident Reports, in summary, on Tuesday, May 12, 2026 he received a complaint about a dog running loose in Hambleton. He advised that it was reported to him the dog appeared to be very skinny and had no collar. He traveled to the area to attempt to locate the dog but was unable to do so. He advised while attempting to locate the dog he received a call that advised an individual had the dog. Thompson retrieved the dog and placed it in the Tucker County Animal Shelter.
He advised that on Wednesday, May 13, the dog was taken to Wild and Wonderful Veterinary Services for a medical evaluation. He advised he believes the owner of the dog is Roy Tuesing, Jr. He advised he tried to contact the owner at his residence, but unable to do so. At this time, he left a notice attached to the door of the property to notify the owner.
Thompson advised that on Thursday, May 15 he again traveled to Tuesing’s residence where he did speak with him. Tuesing stated the dog was his and he attempted to look for it on Wednesday but was unable to find it. He stated he could not afford to have the dog put down due to its age and health condition. Thompson advised him how he could reclaim the dog but he stated he did not have the money for the fees nor the heart to have it euthanized. Thompson provided him with a copy of the veterinarian report. Thompson provided photographic evidence depicting the dog’s poor condition to Zirk.
Charles William Miller, of Thomas, was charged with one count of Failure to Register Sex Offender (Lifetime) 1st Offense. According to the complaint, on July 1 Sgt S.P. Miller met with the defendant, a known and registered sex offender in Tucker County. The defendant reported for his annual sex offender registry requirements and during same, advised that he had lost his job on May 8 from Allied Universal Security at Mettiki Coal in Grant County. WV. Through Sgt. S.P. Miller’s investigation, he confirmed with Allied Universal Security that the defendant’s last date of employment was May 8, 2026 and he also confirmed with the Sex Offender Registry in Charleston that the defendant was on the registry for life. Elkins Communications, also along with Charleston confirmed the defendant has no prior convictions for failure to register as a sex offender. The officer also checked his detachment file which showed the last time the defendant reported was on July 16, 2025 for his annual sex offender registration as well.
Brandon Lee Bryant, was charged with one count of Trespass on property other than structure or conveyance. The complaint states that on Wednesday, June 3, officers were dispatched by Tucker County Communications (911) to 22 Blackwater Avenue in Davis (BFS Foods) for a trespass complaint. Sgt. B.T. Zirk of t he Tucker County Sheriff’s Office and Trooper Tate of the West Virginia State Police responded. While enroute, 911 advised the officers that the suspected trespasser is Brandon Bryant. Upon arrival, officers met with the complainant who provided a handwritten and signed statement. In summary, they stated a customer told him Brandon Bryant was outside. They stated they asked the defendant to leave or they were going to call the police. and he got mad about it and said he didn’t care. When asked where the defendant was it was stated that he was outside the window if Little Ceasars.
Zirk spoke with an employee of the pizza shop and he stated the defendant was digging in the cigarette butt disposal for about 40 minutes.
At this time, it was advised by BFS that the defendant had an active “No Trespassing Notice” against the defendant for the store located at 22 Blackwater Avenue. The notice trespasses the defendant from both businesses located in the same building.
Zirk was supplied with surveillance footage of the defendant standing outside the building. He was served the No Trespass Notice on April 23, 2026 by Tucker County Sheriff’s Office Process Server Ernie Nestor.
