The following citations have been recorded in the Tucker County Magistrate office:
William G. Ball, Jr., Parsons, was cited for speeding (59-55) by TFC J.J. Schmidle. He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
Robert V. Kelly, III, Carlisle, Pa. was cited for failure to tag deer by the WCDNR. He was assessed fines of $20 and court cost of $175.25.
Matthew W. Benson, Morgantown, was cited for No MVI and no insurance by Cpl. D.W. Burge. He pled no contest to the first charge and was assessed fines of $4.75 and court cost of $165.25. The second charge was dismissed with proof shown.
The following criminal complaints have bee recorded in the Tucker County Magistrate court:
Clayton Bruce Schuette, Gaithersburg, Md. was charged with Disorderly conduct, two counts of Obstructing officer and Criminal Identification Bureau. The complaint states that on Sunday, Nov. 17 at approximately 6:39 p.m. officers were dispatched to 5th St in Davis for a welfare check regarding an individual, later identified as the defendant, laying in a ditch. Cpl. B.T. Zirk of the Tucker County Sheriff’s Office (TCSO) and TFC J.J. Schmidle of the West Virginia State Police (WVSP) responded. While in route officers were given a description of the individual. Zirk located Schuette walking along Thomas Ave near the Sawmill Restaurant. He began to talk to the defendant and conducted a terry frisk of his own safety. Schmidle arrived on scene shortly after. Zirk observed alcohol on the defendant and his hooded sweatshirt was on backwards. While talking to the defendant he began to raise his voice and use profane language. He was asked multiple times to stop cursing and he refused to do so. He was asked if he would go to the hospital with EMS and he stated, “I will get raped again, but I will go anyway.” Zirk attempted to ask the defendant about his rape comment and he would not reply. Once EMS arrived they attempted to talk to the defendant and he became irate and threw all his stuff on the ground and began to raise his voice. Officers attempted to calm him down and then he became aggressive toward the officers. He was then place on the ground where he remained and continued to argue with and curse the officers. He was advised by Zirk that he was under arrest and was assisted to his feet and handcuffed. While attempting to handcuff the defendant he began to tense up and allegedly attempted to pull away from the officers. He was then placed in Zirk’s cruiser and transported to the Parsons Detachment of the WVSP for processing. While en route to the detachment he again started to yell and curse toward Zirk. He allegedly unbuckled his seatbelt and began to bang his head on the cage in the cruiser and continued to do so after he was ordered to stop. Once arrived at the detachment officers attempted to talk with the defendant and due to his combativeness and failure to cooperate officers decided to transport directly to RVRJ. He was asked if he would provide fingerprints and he stated “No.” The defendant allegedly began to curse and yell at the officers and made multiple comments of wanting to escape and kill himself. Upon arrival at TVRJ he then began to argue and became combative with the correctional officers. A PR bond of $1,300 was posted.
Eddie Ray Collins, Elkins, was charged with Possession of methamphetamine, Possession of marijuana less that 15 grams 2nd offense, controlled substance. According to the complaint, on Friday, Nov. 29 at approximately 2 p.m. Chief J.E. Kopec and Lt. D.E. Gidley were conducting road patrol along Kohler and Poplar St. when the accused, Eddie Ray Collins, failed to stop at the intersection stop sign. Collins then noticing the police vehicle stopped in the middle of the intersection. Gidley pulled the vehicle over for said violation and approached the vehicle, requesting driver’s license, registration and proof of insurance. The driver was identified from previous encounters by Gidley. Collins could not furnish the requested documents however did provide his name and date of birth. It was found through a license check that his license was suspended for unpaid citations and a driving suspended conviction on June 4, 2018. The defendant was noticed to be nervous and could not give a reasonable explanation for his travels in the Pulp Mill bottom. He allegedly stated he was driving around looking for a motor and was from Elkins. He allegedly admitted there was marijuana in the vehicle. A search of the vehicle yielded a small baggie containing white crystal like substance of what is believed to be meth recovered from the center console. Collins allegedly admitted it was his and informed Kopec it was meth. Also recovered from the same area was a clear sandwich baggie containing a green leafy substance believed to be marijuana. Kopec recovered two glass pipes believed to be used for smoking meth and other clear plastic bags with a white powdery residue. Collins does have previous convictions for possession of a controlled substance on Dec. 20, 2016 and Dec. 3, 2015. Collins was transported to the Parsons Police detachment for fingerprinting and then to the TVRJ. He posted a $2,000 PR bond and a court hearing is scheduled for Jan. 22, 2020 at 10 a.m. before Magistrate William M. Miller.
Catherine Doherty, Keswick, Va. was charged with one count of Domestic battery. The complaint states that on Nov. 20 Chief Deputy M. Sigley and Cpl. B.T. Zirk were dispatched to 46 Lochoa Dr. in Davis in reference to a physical altercation between two female subjects. Upon arrival Sigley was advised that the individuals involved are separated. Sigley spoke with Natalie Arabie who advised that she was with Dahlia in her room talking. She advised she heard Cat talking about somebody talking about her and Micah. She advised she went to ask if she was talking to us and Catherine yelled “shut up Natalie.” Yelling and name calling ensued and soon an altercation broke out between Natalie and Catherine. Natalie advised that she went to poke at Cat’s eye, missed and her thumb went inside her mouth and she bite her thumb. Sigley spoke with the defendant and she advised that she and Natalie got into a verbal argument which escalated and Natalie lurched towards her. She advised she allegedly pushed her shoulders back and Natalie swung at her face. She said she was struck on the side of the face and she swung back. She advised Natalie put her thumb inside her mouth and she allegedly bit her. Doherty advised that once they were on the ground she was restrained by a friend and Natalie punched her in the face while she was unable to defend herself. She posted a $500 PR bond and a court hearing is scheduled for Jan. 8, 2020 at 10:30 a.m. before Magistrate William M. Miller.
