Magistrate News for May 20, 2014

The following citations have been recorded in the Tucker County Magistrate office:

 

  •  Jason David Poling, of Grafton, was cited for no seatbelt by Sr. Trp. J.J. Schmidle.  He was assessed fines of $25.
  • Alexandrie Malai, of Fall Church, was cited for no passing zone by Sgt. C.D. Siler.  He pled no contest and was assessed fines of $4.75 and court cost of $165.25.
  • Christina Bever, of Davis, was cited for no proof of insurance and no operators by Sr. Trp. J.E. Kopec.  He pled no contest and was assessed fines of $200 and court cost of $165.25.  The second charge was dismissed.
  • Candice C. Foster, of Philippi, was cited for failure to maintain control by TFC M.S. Wetzel.  He pled no contest and was assessed fines of $4.20 and court cost of $165.80.
  • Matthew D. Evans, of Eglon, was cited for having a loaded gun in a vehicle by T.L. Fluharty.  He was assessed fines of $20 and court cost of $165.25.
  • Joseph J. Sabatina of Elkins, was cited for no proof of insurance by Dep. C.R. Donelson.  He pled no contest and was assessed fines of $200 and court cost of $165.25.
  • Christopher R. Koffman, of Virginia Beach, Va., was cited for public intoxication and underage consumption by Donald B. McFarlan.  He was assessed fines of $4.75 for each charge totaling $9.50 and court cost of $165.25 for each charge totaling $330.50.

 

The following cases have been adjudged by the Tucker County Magistrate Court:

 

  • Wesley Scott Moats, of Parsons, received judgment of Guilty Plea of one count DUI, controlled substance or drugs, which occurred on February 5.  He was fined $100 plus costs and fees of $240.25.  So Ordered and Adjudged by Magistrate Riley H. Barb on May 15.
  • Ashleigh Suzanne Oliver, of Davis, received judgment of Guilty Plea Agreement for one count unlawful acts by persons (purchasing for minor) violation date of December, 4, 2013.  She was fined $100 plus costs and fees of $165.25.  She also received ten days jail time, which was suspended plus unsupervised probation for a six month period beginning May 14 and ending November 15.  Case was Ordered and Adjudged by Magistrate Riley H. Barb on May 14.  She also received judgment of Dismissed by Magistrate-State-Fee for one count contributing to delinquency or neglect of a child which occurred on December 4, 2013.
  • Bernie J. Phillips, of Hambleton, received judgment of Guilty Plea Agreement for one count repeatedly harasses or repeatedly makes credible threats which occurred on March 23.  He received a six month suspended jail sentence by must report to Day Reporting Center for six months and attend Anger Management Classes.  He must pay cost and fees of $165.25.
  • Dylan Simmons, of Parsons, received judgment of Guilty Plea for three counts making, issuing, worthless checks with violation dates of May 23 and May 27, 2013.  He must pay costs and fees of (1) $215.25 plus restitution of $37.55; (2) $190.25 plus restitution of $35.25; (3) $190.25 plus restitution of $64.27.  Case was Ordered and Adjudged on May 7 by Magistrate Carol D. Irons.
  • Deedee Ann Loughrie, of Rowlesburg, received judgment Guilty Plea for one count DUI which occurred on November 8, 2013.  She received a suspended jail sentence of 30 days by State’s recommendation. She is on unsupervised probation for 30 days and must pay fines of $100 and cost and fees of $165.25.  Case was ordered and Adjudged on May 15, by Magistrate Riley H. Barb.
