The following citations have been filed in the Tucker County Magistrate office:
- Wesley Allen Shifflett, Jr. of Junior was cited for No seatbelt by Cpl. M.A. Roy. He pled guilty and was assessed fines of $25.
- Deeanna Marie Winkler of Cresaptown, Md. was cited for Speeding (59-45) by Cpl. M. A. Roy. She pled No contest and was assessed fines of $4.20 and court cost of $165.80.
- Miranda Lynn Reckart of Parsons was cited for No proof of insurance by Sr. Trp. J.J. Schmidle. Proof was shown and charge was dismissed.
- Travis Keith Phelps of Frederick, Md. was cited for Speeding (29-25) by Dep. C.R. Donelson. He pled No contest and was assessed fines of $4.75 and court cost of $165.25.
- Shannon Elizabeth Anderson of Davis was cited for Speeding (65-55) by Chief Dep. E.C. Surguy. She pled No contest and was assessed fines of $4.75 and court cost of $165.25.
- Kenneth Ray Smith of Hambleton was cited for No seatbelt by Sr. Trp. J.J. Schmidle. He pled No contest and was assessed fines of $25.
- Kenneth Ray Smith of Hambleton was cited for Speeding (77-45) by Sgt. C.D. Siler. He pled No contest and was assessed fines of $4.20 and court cost of $165.80.
- Philip J. Rodeheaver of Terra Alta was cited for Fishing without a license by P. Ferguson. He pled No contest and was assessed fines of $20 and court cost of $165.80.
- John Allen Crockett of Winchester, Va. was cited for Speeding (49-45) by Dep. C.R. Donelson. He pled guilty and was assessed fines of $4.75 and court cost of $165.25.
- Michael Glade Bennett of Hambleton was cited for failure to yield at intersection by Cpl. D.W. Burge. He pled No contest and was assessed fines of $4.20 and court cost of $165.80.
- Gail Bentley Helmick of Chesapeake, Va. was cited for Speeding (55-45) by Cpl. D.W. Burge. He pled No contest and was assessed fines of $4.75 and court cost of $165.25.
- Nicholas Brandan Heater of Elkins was cited for Leaving the scene and Failure to give information to police by Dep. C.R. Donelson. He pled guilty on both charges and received fines of $50 for each offense totaling $100 and court cost of $165.25 for each charge totaling $330.50.
- Albert C. Mach of Arthur was cited for Speeding (54-45) by Dep. C.R. Donelson. He pled No contest and was assessed fines of $4.75 and court cost of $165.25.
The following criminal cases have been filed in the Tucker County Magistrate office:
- Katie M. Phillips, 22, of Parsons was charged with DUI first offense. According to the criminal complaint, on Nov. 4 Phillips drove a white Chevrolet Aveo to the residence of West Virginia State Police Trooper J.E. Kopec. Once at the residence, Kopec observed the odor of alcohol on Phillip’s breath. At this time Kopec called Cpl. D.W. Burge who also observed Phillips swaying and having trouble walking upon his arrival. She failed Field Sobriety tests and Breath Test. The defendant advised Burge that she had driven the vehicle to the residence and that her passenger then entered the vehicle and backed it from the driveway, across State Route 72 and over an embankment. She was transported to the Parsons Police Department where a second Breath test was administered and the defendant failed by registering a 0.147 Blood Alcohol Content.
- Kandice L. Sponaugle, 24, of Parsons has been charged with a DUI third offense. According to the criminal complaint, on Nov. 4 Sponaugle was a passenger of a vehicle driven by Katie Phillips of Parsons. The vehicle was driven to the private residence of West Virginia State Police Trooper J.E. Kopec. Upon their arrival at the residence, Kopec noticed the odor of alcohol and called Cpl. D.W. Burge. Before Burge’s arrival, Sponaugle entered the driver’s side of said vehicle and back out of driveway, across State Route 72 and over an embankment. She failed three standard Field Sobriety tests and Preliminary Breath test as well. She was transported to the Parsons Police Department where a second Breath test was administered and the defendant failed by registering a 0.187 BAC. She had made statements to Trooper Kopec that she was driving at the time of the accident. She had been convicted for DUI on July 19, 2011 and also on Oct. 5, 2011, making this arrest a third offense DUI.
- James Payden Michael, 18, of Parsons has been charged with Domestic Assault. According to the criminal complaint, on Nov. 2 Michael allegedly entered his parent’s home in an intoxicated state. He was enraged and broke a mirror and a picture on the wall. The parents called 911, at which time Cpl. D.W. Burge arrived at the residence. Michael failed the Preliminary Breath Test with a Blood Alcohol Content of 0.143. Burge arrested the defendant for Domestic Assault and Underage Consumption.
The following are cases that have been assigned in the Tucker County Magistrate office:
- Forrest Walker violation date Oct. 18 for Operation without certificate inspection or failure to produce certificate. He pled Not Guilty and a court hearing has been set for Jan. 9, 2014 at 10:30 a.m. before Magistrate Riley H. Barb.
- Jessica Long violation dates of Feb. 3, Mar. 31, May 26 and June 23 for, False representation. Case assigned to Magistrate Carol D. Irons. She posted a PR bond of $5,712.
- • Michael Bennett violation date Sept. 1 for Driving while license suspended or revoked; Driving to fast for road conditions; Limitations on overtaking on the left and Driving under influence, second offense. Case assigned to Magistrate Riley H. Barb. He posted a $1,000 PR bond.
- Katie Phillips violation date Nov 4 for DUI first offense. Case assigned to Magistrate Carol D. Irons. She posted a PR bond of $500.
- Kandice Sponaugle violation date Nov. 4 for DUI second offense. She posted a PR bond of $2,000.
- The following Civil case has been heard in the Tucker County Magistrate Court:
- Howard Steven Long verses Danny Arnett, Kimberly A. Arnett, On Nov. 1 Magistrate Carol D. Irons granted judgment Dismissed with Prejudice against Danny Arnett, Kimberly Arnett.
- The case stated that the Arnett’s had quit making monthly payments on a personal loan. The Plaintiff dismissed the case and the parties have settled.
