The following criminal complaint has been filed in the Tucker County Magistrate office:
Virginia Sue Smith, of Parsons, was charged with one count of Driving under influence of alcohol, controlled substances or drugs. According to the complaint, on Friday, Jan. 12 Patrolman First Class N.C. Gidley received a call from Tucker County 911 in regards to a vehicle in Mill Race Park, located on the walking trail that was sideways; driving into a fence and a post.
Gidley, along with Trooper R.S. Musgrave of the WVSP, arrived on scene and observed a black Jeep sideways on the walking trail adjacent to McFadden St. The vehicle was still running and a subject was observed in the driver seat. Musgrave made initial contact with the subject and observed two cases of Bud Light in plain view in the backseat. He asked the driver if she had been drinking and she allegedly stated that she had. He then ordered her out of the vehicle and at this point she was identified as Virginia S. Smith. At this time the odor of an alcoholic beverage emanated from Smith’s person. She appeared to be under the influence and was unsteady on her feet as she was ordered to the parking area.
Field Sobriety tests were administered and she failed and at this time at preliminary breathalyzer test was agreed to by Smith. This test result showed that she was above the legal limit of .08%.
A second test was later agreed to by Smith and it revealed a BAC of .173%. At this time she was taken into custody for driving aggravated DUI. She was processed on the Live Scan at the WVSP Barracks in Parsons and then transported to TVRJ and remanded into the custody of the Division of Corrections and Rehabilitation.
Gregory Dean Smith, Jr. of Ravenswood, was charged with one count of Battery, one county of Destruction of property, one count of Obstructing and one count of Public Intoxication. The complaint states that on Thursday, Jan. 11 Trooper R.S. Musgrave was dispatched by Tucker County 911 to an altercation, physical in nature, at Hell-Benders located in Davis. The officer was advised that the aggressor was being held at this location until law enforcement arrives.
Musgrave arrived on scene and observed a male individual being held on the ground. He was subsequently identified by his Texas license as Gregory Smith, Jr. At this time Musgrave went to place restraints on him and he resisted after the lawful command. He was detained and escorted to the officer’s vehicle. Musgrave noticed an odor of an alcoholic beverage emanating from Smith’s person. Suring a search of Smith’s person, an alcoholic beverage was located and obtained.
The officer observed damage to the restaurant’s front door the window in the door was separated and damaged. Musgrave made contact with Karl Rohr (victim) and he stated that Smith was asked to leave the business multiple times by the workers and he was trying to exit when Smith was trying to re-enter the business. Rohr advised Smith that he should leave and at this point Smith allegedly grabbed at Rohr’s face, causing swelling, redness and multiple lacerations. Musgrave observed and photographed the injuries. During this recorded statement, Musgrave was advised that Smith was kicking and attempting to destroy his vehicle. Musgrave also observed a phone/video of Rohr and Smith’s physical altercation. He also obtained recorded statement from neighboring businesses allegedly stating that Smith entered their establishment in a belligerent manner and was asked to leave.
At this time Smith was transported to Davis Medical Center to receive attention for alleged injuries. He was cleared and was transported to TVRJ.
The above crimes were committed in Tucker County and all individuals are presumed innocent until proved otherwise in a court of law
