The following criminal complaints have been filed in the Tucker County Magistrate office:

  • David Keith Boyles, of Parsons, was charged with two counts of Person Prohibited from Possessing Firearms. The complaint states that on Thursday, April 24 Deputy B.M. Gidley was doing routine patrol on WV72 when he noticed a vehicle traveling north with a headlight out. He turned around and activated his emergency lights to conduct a traffic stop. Driver’s registration information came back to a David Boyles of 1842 Holly Meadows Road. Gidley made contact with the driver and informed him of why he was pulled over. While waiting for driver’s license, registration and insurance Gidley noticed a green pill container in the driver side door handle. The driver had knocked it over and it fell to the floor of the car. When the driver opened the door Gidley noticed a green pipe in the door with burnt residue in it. He asked the driver if that was his weed pipe the driver stated that it was. City police were called to assist and PFC N.C. Gidley arrived to help in the stop. PFC Gidley ran two firearms through Tucker 911, one a Rossi 30-06 which was located in the back driver side seat and a .22 caliber LR in the passenger seat. 911 advised both came back with no record found. B.M. Gidley conducted a vehicle search and he located a small plastic bag containing a green leafy substance, a green smoking device and a green pill container with green residue. He ran a Triple III and a state check for warrants and nothing was found on the driver. He wrote the driver a citation for No Proof of Insurance and a Verbal Warning for Defective Equipment. The contraband was seized and discarded. After the stop 911 contacted B.M. Gidley and advised they had received more information through Triple III that the driver did have a felony conviction. Gidley went to his office and looked through the Triple III paperwork and David Keith Boyles was convicted of a Felony in Morgantown from WV State Police on Oct. 21, 1983 for Breaking and Entering. On Oct. 31, 1983 he pleaded guilty and was convicted with three years’ probation.
  • David Jefferson Boyles, of Parsons, was charged with one count of Possession. According to the complaint on Monday, April 28 Deputy B.M. Gidley along with members of the WVSP, City Police and WVNRP executed a search warrant at 1842 Holly Meadows Road, in regard to a prohibited person in possession of a firearm and drugs. Upon entering the residence Gidley announced himself and opened the door of the residence. He saw a male subject, later identified as David Jefferson Boyles lying on the couch. Gidley advised him to get dressed and come outside of the residence. He asked if anyone else was in the house and Boyles advised that his mother was in the other room. Gidley made contact with the mother who is on oxygen and bedridden. Gidley advised her that a search warrant was being executed and he would have someone stand with her in the bedroom so she could remain on oxygen. Deputy Gidley, PFC Gidley and NRP Dudley proceeded to search the house for the items. Dudley located a clear container with a crystal-like substance inside. Deputy Gidley and PFC Gidley did a field test on the substance. A Mobile Detect Field Test was conducted and presumptive positive for Amphetamine was detected. WVSP Trooper Hahn mirandized David Jefferson Boyles on bodycam and stated that it was his drugs that were located and took responsibility.
