Criminal Complaints Filed in Tucker County Magistrate Office

John Allen Boyles of Parsons was charged with one count of Domestic Battery. According to the complaint, on Sunday, May 25 at approximately 8:25 p.m. Trooper R.K. Stewart was dispatched to the area of 168 Pennington Trailer Court for an active domestic violence incident. Upon arrival, the Trooper was advised by Tucker Communications that the victim had left with her mother and was no longer at the residence. He attempted to make contact with the accused, later identified as John Allen Boyles, which he was unsuccessful. Deputy C. Summerfield was also on scene when a red vehicle approached the residence. A male exited and was identified as the accused.

Trooper Stewart was advised by Tucker Communications that the victim went to Davis Medical Center in Elkins. He contacted Senior Trooper C.A. Hawkins of the WVSP Elkins Detachment to go to Davis Medical Center to obtain photographs and a statement from the victim. Stewart was advised by Hawkins that the victim did obtain injury from this incident and was advised by the victim that she obtained other injuries from incidents over the last few days.

Due to the totality of these circumstances, Trooper Stewart placed the accused under arrest for domestic battery and transported him to the WVSP Parsons Detachment for processing and then on to TVRJ to await arraignment.

David John Scott of Parsons was charged with one count of Misdemeanor offenses for violation of protective order. The complaint states that on Thursday, May 15 Tucker County 911 received a call from the victim stating she wanted to report a DVPO violation for a DVP against the David John Scott. On this same date at approximately 8:20 p.m. PFC Gidley with the Parsons City Police met with the victim who stated at approximately 5:30 p.m. she made a post on Facebook. She stated at approximately 7:50 p.m. the suspect commented on her post. Trooper R.S. Musgrave obtained screenshots of the post along with the comment by the suspect. Musgrave obtained a copy of the DVPO and acknowledged that one of the requirements was that there was to be no direct or indirect contact with the victim. Both parties were served on April 6, 2025 and will be in effect until August 4, 2025. The victim stated that she discovered the suspect’s comment while she was traveling on US 219 in the Wild Maggie area in Hambleton.

Sara Elizabeth Davis of Parsons was charged with Shoplifting and Conspiracy. According to the complaint Patrolman First Class N.C. Gidley received a direct complaint from Store Manager Ellen Freeman in reference to a suspected shoplifting that had occurred on May 15 at the BFS in Parsons. Gidley met with her and she stated, in summary, that she ad been approached by an employee regarding a suspected theft of alcohol. She stated that just prior to midnight on Tuesday, April 15, two suspects (one male and one female) entered the BFS wanting to purchase alcohol and left shortly after without paying for any items. Freeman then stated that she reviewed the CCTV footage and observed the female subject pick up a bottle of alcohol, remove the security tag and then uses her coat to conceal the bottle of alcohol before leaving the store.

Upon reviewing the footage Pfc Gidley observed the female subject, identified as Sara Elizabeth Davis, and the male subject, identified as Joshua Ellis Runner enter the liquor section at approximately 11:51 p.m. Both parties appear to be looking at and discussing multiple bottles of alcohol and at approximately 11:56 p.m. Davis is observed holding a bottle and appears to be removing the security tag from the bottle. At approximately 11:57 p.m. Davis is observed making a motion consistent with placing the security tag on the underside of the shelf. It appears that both parties come to an agreement on the alcohol, and Davis is observed taking off her coat and placing the bottle of alcohol inside of it. Both parties then exit the store without paying for any goods or items.

Pfc. Gidley was advised that the bottle of alcohol was Amaretto Di Amore valued at $15.99 before tax. A criminal history check was conducted on both parties for prior shoplifting charges and came back that both parties have charges in Randolph County with no listed disposition. This crime was committed in Tucker County.

All individuals are presumed innocent until proven otherwise in a court of law.
