The following criminal complaint has been filed in the Tucker Magistrate office:
Joshua David Poling: was charged with Brandishing deadly weapons; threatening or causing breach of the peace (2 counts). According to the complaint on Wednesday, June 4 at approximately 6:56 p.m. Cpl. C.R. Summerfield of the Tucker County Sheriff’s Office (TCSO) was dispatched to the Splash Park in Parsons by Tucker County Communications (911). They advised that the caller stated someone was being threatened by a man with a gun on his side. While enroute to Parsons 911 advised that they received an additional call from the victim. He advised that he was at the Sheriff’s Office. Summerfield contacted the initial caller by telephone and was advised that her children saw the man at the Splash Park with a gun.
Summerfield and Trooper R.S. Musgrave of the West Virginia State Police (WVSP) arrive at the TCSO and are met by the caller and his wife. Officers obtain a handwritten and signed statement from them. In summary they stated that at approximately 6:45 p.m. his sister confronted him at the Splash Park because he let her daughter meet a friend in Parsons. He stated he told his sister that the man she was with, Joshua David poling was a pedophile and said that Poling took offense to his statement and pulled up his shirt, revealing what looked to be a pistol. Before Poling got in the car, he took his shirt off to show the presumed weapon again. The victim stated that Poling presented the weapon, threatening him twice. In summary the female victim stated that her daughter and Poling came to the Splash Park and started yelling about Z.S. (11-year old juvenile) being around town. After the argument a woman on the opposite side of the Splash Park offered to call the police and asked what was going on. The woman told the female victim that Poling had a weapon. This crime took place in Tucker County and all parties are presumed innocent until proven otherwise in a court of law.
