The following criminal complaints have been filed in the Tucker County Magistrate office:
James Edward Denton: Davis, was charged with one count of Battery. According to the complaint on Wednesday, March 30 at approximately 5:52 p.m. Patrolman N.C. Gidley received a call from Tucker County 911 to respond to Walgreens in Parsons in regards to a Pharmacist stating that his technician was “assaulted by a flying box of Moon Pies.”
At approximately 6:26 p.m. Gidley arrived at Walgreens and met with the Pharmacist and the victim. The Pharmacist stated that a male individual identified as James Edward Denton had come into the store to obtain his wife’s medication. The Pharmacist stated that when he checked his computer, it showed that Denton had obtained that prescription from multiple pharmacies. He told Denton that he would have to make a call to the doctor that prescribed the medication before he could fill the request. He stated that Denton became very agitated and belligerent. At which point the victim went and spoke with Denton, trying to calm him down. After he had calmed down, the victim started back into the Pharmacy area when the defendant allegedly hit her in the buttocks with a box of Moon pies.
Gidley then spoke with the victim who stated that Denton was angry with the Pharmacist because he would not give him the medication and the victim was attempting to calm him down. The victim stated that Denton allegedly said that he would be mad enough to pull the Pharmacist out from the counter. The victim stated that she then smiled and walked away when Denton proceeded to smack her butt with a box of banana Moon Pies before putting them back on the shelf and leaving the store. The victim stated that being smacked on the butt made her feel weird and she stated that she does not the idea of other people touching her.
Gidley reviewed video footage of the incident and it shows Denton sitting in a chair outside the pharmacy and the victim standing beside him. The victim turns to go back into the Pharmacy and Denton is seen starting to stand up out of the chair when his arm makes a sweeping motion towards the backside of the victim’s body. The incident occurred at approximately 4.10p.m., but had not been reported to the Pharmacist until later on.
Tucker County 911 contacted Gidley stating they were able to find a James Edward Denton out of Davis and he requested a DMV photo of the subject to which he showed the victim. The victim positively identified the individual in the photo as the individual from the above stated incident.
Darren Tyler Wyatt: Belington, was charged with three counts of Non-consensual disclosure of private intimate images. On April 5 the victim, Beverly Ann Cantrell came to the West Virginia State Police Parsons Detachment to file a complaint. Upon arrival, she advised that her complaint involved personal photographs which she had sent to her then boyfriend, Darren Tyler Wyatt, hereafter the defendant. She further stated that she had been approached by an acquaintance in Tucker County on Feb. 3 and made aware of at least one photograph which had been posted to a site on the web. The site is known as a pornographic social media page in which individuals can post photos in different “threads” that are sometimes geographically specific.
She further stated that she believed it was in fact the defendant due to a break-up which occurred in April 2021. During that time period, she had been in conversation with him on facebook Messenger. Those conversations include threats to post videos and pictures (image) which were sent by the victim while they were involved in an intimate relationship. She stated that at no time did she ever give permission for him to post or otherwise disseminate the “image” to anyone or any intity. Sgt. V.J. Pyles was provided with screenshots of the conversations while the victim was at the WVSP detachment. The defendant had allegedly threatened on April 2, 2021 to upload thee pictures in the following message, “Unfriend me and by the way I’m uploading your pics you did send on a website. This is in violation of WV CODE but is outside the time frame required to report the activity to law enforcement. Also on April 2, 2021 the defendant sent a message allegedly stating “F*** it wanna be like that and such your screenshots are online.”
However on April 11, 2021 a message was sent from the defendant to the victim allegedly stating, “It’s all good your pics are on snapchat anyways, have a good life.”
On April 27, 2021 the defendant once more made the following threat while engaged in conversation with the victim, “Now that I know the address there haha you best believe I”ll be there, you just f***** with the wrong person!! Wanna block me on my number better block me here on here, and I will be getting my charger from your place, and you won’t even know what else I do.” Allegedly the defendant further threatened, “Every one of those m***** f****** are getting your vids and s*** sent wanna accuse me of s*** imam f****** do it and f****** see.”
On April 6, 2022 Pyles met with the Tucker County Prosecutor, Savannah Wilkins and she was aware of the image that had been in circulation in Tucker County and had previously been supplied with a copy of said picture. The picture had been posted to a website on May 10, 2021. The photograph was in fact the victim in a state of undress. The image sent to the defendant was said to have originated in Tucker County.
Tyler Wade Midkiff: Branchland, WV, was charged with one count of Failure to maintain control and one count of Driving under the influence of alcohol BAC greater than .15. The complaint states that on Tuesday, April 19 at approximately 9:22 p.m. Cpl. J.J. Cornelius responded to a two vehicle crash on WV32 near Davis. Upon arrival he observed a black Toyota Tacoma facing south off the eastern roadway edge along with a Chrysler Pacifica also off the eastern roadway edge facing south. The officer spoke with the driver of the Pacifica, Joyce Moore, who advised she observed a truck on her side of the road and drove off the road to keep from hitting head on. Moore indicated after the crash the other driver asked if she was okay and requested to pay her.
While investigating the scene, numerous first responders indicated the other driver appeared impaired and that he was currently located in the fire truck. Cornelius spoke with the drive and requested his driver’s license and after some difficulty he handed the officer a credit card which he proceeded to drop onto the roadway. The officer requested once again requested a driver’s license and he eventually produced one and was identified as Tyler Midliff.
Cornelius could smell the odor of alcohol as Midkiff spoke and he observed his eyes appeared glassy and bloodshot. Midkiff was asked to exit the vehicle and was unsteady on his feet as he walked.
Field sobriety test were administered and all were failed along with a preliminary breath test. The accused was transported to the Parsons Police Department for secondary chemical testing. After the West Virginia Implied Consent Statement was read and completed, the accused decided to provide a sample to the Intoximeter which showed results of a blood alcohol concentration of .212%.
