The following criminal complaints have been filed in the Tucker County Magistrate office:
Clayton K. Mallow, of Dry Fork, was charged with one felony count of Unauthorized Use of a Controlled Access Device. According to the complaint on Oct. 21, 2022 Sgt. V. Pyles was contacted by a female regarding a fraudulent charge located on her Mountain Valley Bank statement. She was alerted to the possible fraudulent charges by her daughter. The records show that on Oct. 17, 2022 an individual attempted to transfer $10,541.44 from her bank account to an Apple Card (Goldman Sachs Bank). Through the information provided by the victim, Pyles was able to gain the holder’s identity with a search warrant to Goldman Sachs Bank. He discovered that Daniel Mallow was the name that appeared on the account. There was no cell phone or email for the individual. The phone number associated to the Apple Card is that of Clayton Mallow who resides with Daniel Mallow at the same address. Daniel Mallow denied ever having an Apple Card.
Further investigation revealed the defendant is employed in Parsons at Nationwide Insurance. The victim has Nationwide insurance and will go to the location in person to pay her premium monthly by CHECK. A check will contain enough information for an individual to attempt an electronic transfer of funds “EFT” or will show as “ACH” on banking records. The Apple Card had the victim’s banking information attached as a payment method. A notice was sent to the defendant stating that the account had been removed as a payment method due to the unsuccessful transaction. The transaction was denied due to the amount and lack of funds. It is alleged that the defendant had access to the victim’s personal information and used the same to attempt a large money transfer “ACH” commonly known as “EFT” on one occasion which is unauthorized use of a control access device.
Christopher Lee Cunningham, of Winchester, VA, was charged with one count Driving Revoked for DUI. The complaint states that on April 7, 2023 Deputy B.M. Gidley resp0nded to a motor vehicle accident on US219 around 4362 Seneca Trail. Once he arrived on scene, Trooper C. Hawkins was on scene obtaining vehicle information and driver information. Hawkins radioed Tucker Communication for the driver’s information. 911 responded and advised that the defendant’s driver’s status was revoked for DUI 2nd through Virginia effective date May 5, 2021.’ The defendant was with EMS getting medically cleared. After he was medically cleared Gidley asked if he knew his license was revoked for DUI. The defendant advised he knew it was at a point and did classes to get them back. Gidley advised him that his license was still revoked for DUI through Virginia so he was still going to be placed into custody for driving revoked for DUI in West Virginia. The defendant was transported to WVSP Parsons Detachment for processing.
Jordan Douglas Brown, of Parsons, was charged with one count of Domestic Battery. According to the complaint Patrolman First Class N.C. Gidley received a call from Tucker County 911 regarding a domestic disturbance at BFS, located at 200 First St. in parsons. Tucker 911 advised that an employee with BFS called in and stated that a female came into the store fighting with a male subject and was bleeding.
Tucker 911 also advised the WVSP Trooper Hawkins was en-route as well from the Elkins area and had requested for PFC. Gidley to be contacted to respond. Gidley had Tucker 911 contact EMS and have them respond due to the female bleeding and not knowing the extent of the injuries. Gidley arrived on scene and spoke with the BFS employee who in summary stated that the woman had come running into the store screaming and was being chased by a male subject. He stated that he would not let the male subject come into the store and he left walking in the direction of Chestnut St. The employee saw that the female was bleeding and called EMS.
Gidley made contact with the victim who stated that she had gotten into a verbal argument with Jordan Brown which then turned physical when she attempted to take some medicine for a headache. She stated that Brown allegedly took the bottle of medicine and threw it across the room. When she attempted to pick up the medicine He slapped the bottle out of her hand. She stated that she then attempted to untangle a cord when he grabbed the cord and hit her with it, which left a mark on her leg. She said that Brown allegedly grabbed hold of her which resulted in her shirt being torn. She said that she then left the apartment and ran to BFS. This altercation occurred at the Tucker Manor.
Gidley observed a red mark on the left leg of the victim as well as red marks on her wrists and arms and a tear on the left shoulder of her shirt. He also observed that the victim was bleeding from her foot, which she stated happened when she was running from Brown. The victim did not wish to be checked by EMS and Tucker 911 was informed to cancel their response. Hawkins arrived shortly after and obtained a written statement from the victim and made contact with Tucker 911 in regards to contacting Women’s Aid in Crisis.
After the Women’s Aid in Crisis worker arrived on scene Gidley and Hawkins proceeded to Tucker Manor and made contact with Brown who stated that the altercation was about her attempting suicide with a knife and possibly pills. Brown state he did grab hold of her wrists in order to keep her from using the knife but denied any additional physical contact with the victim. Brown was then placed under arrest for domestic battery. He was then transported to the WVSP Barracks for processing by Gidley and transported to TVRJ by Trooper Hawkins.
All the above incidents occurred in Tucker County and all individuals are presumed innocent until proven otherwise in a court of law.
