The following criminal complaint has been filed in the Tucker County Magistrate office:
• Ines Mamani Rocha, of Annandale, Va. Was charged with one count of Engaging in business without a business franchise registration certificate. According to the complaint, the criminal case was opened with the West Virginia State Tax Department on Monday, Jan. 12, 2026 as a result of a labor inspection performed by Randy Utt, Inspector with the West Virginia Labor Department, on Oct. 10, 2025 at 751 Fifth Avenue in Davis.
During the labor inspection on Oct. 10, 2025 performed by Utt, he contacted an employee of KC Home Improvements, LLC, of Annandale, Virginia and other undocumented employees doing remodeling of a kitchen and bathroom. The employee contacted, by phone, a subject who identified herself as Ines Love, who claimed to be the owner of KC Home Improvement LLC. She was later identified as Ines Mamani Rocha who owned Casey Home Improvement LLC at the same Virginia address. This was confirmed through Virginia Secretary of State records.
Upon checking, neither KC Home Improvement LLC or Casey Home Improvement LLC was licensed in West Virginia and there was not proper documentation for employees on site. Utt provided a copy of the labor report.
Upon review of the tax accounts in West Virginia, it was found that Ines Mamani Rocha, KC Home Improvement LLC did not have a West Virginia Business License and is not licensed to do business in West Virginia.
• Carley Brooke Mallow, of Huntington, was charged with one count Obstructing officer and one count of Making false statements to officer. The complaint state that on Saturday, Jan. 31, Corporal N.C. Gidley received a call from Tucker County E911 reference to a two-vehicle crash that occurred in the BFS parking lot. The caller stated a vehicle was spinning around the parking lot and struck her parked vehicle. The caller also advised that the driver was possibly intoxicated.
At approximately at 1:06 a.m. Gidley arrived at BFS and met the involved parties. They were identified as Grant W. Poling, Krista M. Heckler and Carley B. Mallow. Poling and Heckler were inside the vehicle that caused the collision (2000 Subaru Legacy owned by Poling), while Mallow was the operator of the vehicle that was struck (2007 Ford Edge). Mallow was parked at the time of the collision and was outside the vehicle.
Upon speaking with Gidley, all parties, including Mallow, stated that Heckler was operating the vehicle and that Poling was a passenger. The odor of an alcoholic beverage was observed by Gidley, emanating from Poling’s person, as well as what appeared to be bloodshot and glassy eyes. Upon being questioned regarding alcohol or intoxicating substances, all parties denied the use of. While speaking with Heckler and Mallow, no odor of an alcoholic beverage was detected coming from their persons.
The parties exchanged information and left the area. The assistant manager from BFS then arrived and showed Gidley the CCTV footage of the incident. After the collision, it is observed that the male subject exiting the driver’s seat of the vehicle was Poling.
Based upon the totality of the circumstances, it is believed that by all parties stating Poling was not operating the vehicle, the observation of the odor of an alcoholic beverage emanating from Poling, the blood shot and glassy eyes and the CCTV footage; that all parties involved provided false statements to the officer and obstructed by hindering the investigation of a possible DUI-related crash.
