The following criminal complaint has been filed in the Tucker County Magistrate office:
Sophia Odescia Blackshear, Elkins, was charged with one count DUI with un-emancipated minor. On Wednesday, May 13 Officer, C.R. Summerfield of the Tucker County Sheriff’s office, (TCSO) along with Trooper C.A. Hawkins of the West Virginia State Police (WVSP) responded to a single vehicle collision on WV32 in Dry Fork. Once on the scene the officers spoke with members of the Canaan Valley Fire Department who stated that the vehicle was on its side with two occupants trapped inside, the driver later identified as Sophia Blackshear, along with her four year old child in the back seat. Hawkins spoke with a witness identified as Adam Bee who was traveling southbound on WV32 when the crash took place. A handwritten and signed statement was received from him. In summary he stated that he was driving and saw a vehicle coming toward him at a high rate of speed. The vehicle left the roadway around a driveway and went air-born. He also stated he helped the fire department remove the passengers from the vehicle. Mr. Blackshear and her son were transported to Davis medical Center by Tucker County EMS, therefore, officers did not get a chance to speak with them on scene. Summerfield obtained photographic evidence of the scene, however, could not acquire measurements due to the vehicle being moved by the fire crew in efforts to remove the trapped passengers. Two separate properties were damaged due to the crash, a field leased by Wesley Harman and his father along with the front yard of Clyde Allman. Both parties arrived on scene and gave Hawkins their contact information.
Summerfield contacted DMC around 9 p.m. to speak with the defendant in order to obtain more information regarding the crash. At approximately 9:30 p.m. officers from Elkins Police Department contacted Hawkins stating that the hospital and called and told them the four year old juvenile was not Blackshear’s son, and that alcohol was detected in her blood. CPS was also contacted by DMC. Hawkins passed along the contact information of the Elkins Police Department to Summerfield. He spoke with Elkins PD and advised them that he was in route to the hospital to obtain a statement from Blackshear about the crash. He met with CPS at the hospital and obtained more information regarding the incident. CPS informed him that Blackshear was the four year olds foster mother. He obtained a handwritten and signed statement from Blackshear and in summary she stated that she allegedly had a few drinks on Smirnoff Ice around 12:30 p.m. that day before exchanging her son. She drove to Centennial Park to meet her son’s father in order to exchange their son. She stated she had two shots of Vodka at Centennial Park with the father to celebrate Mother’s Day. She stated that on her way home, she swerved to miss a deer right outside Canaan Valley and lost control of the vehicle causing her to crash. Summerfield noticed her eyes were glassy and that she seemed confused. He asked her if she would be willing to sign a consent form (Authorization for disclosure of health information) that was provided by nurses at DMC to which she agreed and signed. After reviewing the results it was determined that she had 143mg (1.43) of alcohol in her blood, were intoxication occurs at 80 mg (.08). This investigation is currently ongoing.
