The following criminal complaint has been filed in the Tucker County Magistrate office:

Leah R. Kuss, of Kingwood, was charged with one count of Domestic Battery and one count of Destruction of Property. According to the complaint on Thursday, April 2, V.J. Pyles received a call for service regarding a domestic incident which occurred in Davis between the defendant and another individual. Pyles later interviewed the victim who advised he was struck in the face twice and kicked in the face at least one time while trying to retrieve his cell phone. He advised that he had recorded a conversation while in the presence of the defendant and another male who was at the residence. He further advised that after all the company left the residence, the defendant confronted him about the recording. An altercation took place inside the residence which concluded with the victim being struck about the face by the defendant and his IPHONE 13 being thrown in a washing machine. The victim stated that the defendant then turned on the washing machine thus destroying the phone in the process.

The victim had visible injury to his lower lip at the time of the interview. The victim/defendant were boyfriend/girlfriend for approximately four months.

The defendant was interviewed at or around 9:30 p.m. on April 2 at which time she admitted that she had struck the victim in the face and destroyed his cell phone. The defendant advised that she was angry due to the recording and had been drinking. The defendant had no prior domestic related charges. The defendant made physical contact with the victim causing injury and did unlawfully destroy the victim’s property with a value of $300.
