The following criminal complaints have been filed in the Tucker County Magistrate office:
Marvin Lee Bohon, was charged with one count of Malicious or unlawful assault; assault; battery. The complaint states that on Friday, July 31 Cpl. B.M. Gidley received a call from Chief Deputy Sigley about an assault that had occurred earlier. Sigley advised that himself and other units were unavailable to respond so Gidley met with the victim at the Tucker County Sheriff’s office. He received a handwritten and signed statement from the victim along with a recorded audio statement.
In summary, the victim just got off work and dropped her sister off at her mom’s. She was talking with her fiancé on the phone and saw the accused drive by and she waved at him. A few minutes later he returned and stopped to talk to her. She thought he was going to congratulate her on getting engaged and he then hugged and kissed her on the neck. She advised she had not expected that and it was weird and uncomfortable. He then asked her about her tan and she said she had just gotten back from the beach. He then asked her if she had any tan lines and she said she did and lowered her left shoulder and showed him.
He then asked her to come closer and at this time he grabbed her by her shirt collar and pulled it down and looked down here shirt and said he wanted to see the rest of her tan lines. Her fiancé was pulling in and she pulled away and went over to him. The fiancé advised that the accused told him congratulations on the engagement and from his point of view the accused did act suspicious about something and was anxious to leave. A few minutes go by and the accused gets in his truck and leaves.
John Samuel Sayers, of Thomas, was charged with one county Malicious or unlawful assault and one count of Brandishing deadly weapons. According to the complaint, on Tuesday, Aug. 4 officers were dispatched to Thomas for a complaint. Deputies Zirk and Summerfield, of the Tucker County Sheriff’s Office responded and met with the complainant victim #1 and son victim #2. Victim #2 provided a handwritten and signed statement where he stated the neighbors were giving his grandfather a hard time, so his dad, victim #1 went to his grandfather’s house to make sure everything was okay. Victim #2 stated his dad came back and told him what the neighbors were saying so his dad went back and put up “No Trespassing” signs. He stated he got done washing his four-wheeler, cut the grass, came home got on his dirt back and went to his grandfather’s house. He stated his grandfather told him about everything that happened that day and asked if he could build a wall along the property line, so he went out to check. He said he started riding his dirt bike and while doing so the defendant came up behind him with a pickaxe and started chasing him. He stated he was never on the defendant’s property, but he continued to chase him through his grandfather’s yard. He stated he rushed home and while he was running away, the defendant swung the axe at him but missed. He stated the defendant allegedly said to him, “I’ll kill you.” He said he went home, woke up his dad and called 911. He further stated he was so scared that he went as fast as his bike would go, jumped off and ran inside. He said the defendant posted on Facebook that what he did was savage and that the next time it would be a gun and victim#2 feared for his life.
Victim #1 then provided a handwritten and signed statement that summarized he put up “No Trespassing” signs and blocked the path with blocks. He stated he told the defendant not to come across his parent’s property. So, after things settled, victim #2 went to check the yard to see if they were moving blocks and to see if the signs were still up. At this time, he came home in a panic saying the defendant was chasing him on his grandfather’s property with a pickaxe threatening to kill him.
Victim #2 provided Zirk with a screenshot of the defendant’s post on Facebook. A post under the account name of Juhn Sayers III stated, “I just chased him out of my yard with a pickaxe, that’s savage, not a threat.” Another post under the same name stated, “I have the right to stand my ground on my property, today I only chased him away with a pickaxe, next time it could be a gun, I have begged authorities for help.”
Deputy Zirk and Summerfield went to the defendant’s residence and spoke with him. They asked if he would be willing to provide a statement regarding the incident that occurred earlier and he advised he would. In summary, he stated Monday victim #1 got angry because his workers crossed his property line. He stated that victim #1 had his wife at the corner of the property yelling and cussing, blaming her so he told victim #1 to quit harassing her and get out of here and he left. He stated later his wife called, scared stating victim #2 was popping wheelies and raising hell on a dirt bike up and down the property line. He stated he came home and victim #2 was not there. He stated victim #2 came back and was at his trailer, taking property stakes and messing with his trailer. He stated he chased him away with a broken pick and told him he would beat him up.
