The following criminal complaint has been filed in the Tucker County Magistrate office:
James Malcolm Southern: of Hambleton, was charged with one count of Driving under Influence of Alcohol. According to the complaint on Sunday, Aug.t Tucker county Communication 911 dispatched officers to the area of 2049 Mackeyville Rd. for a UTV accident on the roadway. 911 advised the officers that the driver could possibly be intoxicated. Cpl. B.T. Zirk of the Tucker County Sheriff’s office, Officer Dudley of the WVDNR and TFC J.J. Schmidle of the WVSP responded. Upon arriving on scene Zirk observed a UTV resting on its passenger side in the roadway. He observed a male subject, later identified as James Southern, standing behind the vehicle. Zirk asked him if he needed medical attention and he stated no. Zirk asked him what happened and he stated he was coming back from the gas station and took the turn too fast and hit the ditch. While speaking with him Zirk noticed his speech to be slurred and slow. When asked if he had anything to drink Southern stated no. He was asked if he would submit to a Preliminary Breath Test (PBT) and he agreed. While walking to Zirk’s cruiser He was observed to be staggering. He submitted and performed the test which he failed. Zirk asked him again if he had anything to drink to which he allegedly stated he had some earlier. He was asked if he would submit to field sobriety tests and he allegedly stated he could not do it. He was observed to be having trouble maintaining his balance. He was asked once more if he would be willing to perform FST and at this time he started shaking, fell to the ground and appeared to pass out. Zirk requested Tucker Emergency Medical Services to respond to the scene. Southern then sat up and leaned against Zirk’s cruiser. Zirk again asked if he needed medical attention and Southern stated yes. At this time his wife arrived on scene. While speaking to Mrs. Southern, she advised officers that he had allegedly drank an entire bottle of vodka before leaving the house and that he drives drunk often. Southern was transported to Davis Medical Center by EMS.
