The following criminal complaints have been filed in the Tucker County Magistrate office:
Jocelyn Marie Ellis, of Red Creek, was charged with a felony count of Shoplifting 3rd Offense. According to the complaint, on Saturday, July 20 Senior Trooper C.A. Hawkins was dispatched to the Shop-n-Save in Davis for a shoplifting complaint.
At approximately 7:58 p.m. he arrived on scene and made contact with the employee who called in. He stated that a customer approached him about another customer shoplifting. He stated that he had watched the cameras and saw the suspect steal a bottle of wine and he called police.
The officer was shown the security video of a female putting a bottle of wine in her purse and then provided the officer with the registration of the vehicle that the suspect left in. The registration came back to Brenda Clemente and the employee advised the officer that Brenda is the mother of the suspect and they live at the same address.
On Monday, July 22 Hawkins traveled to the address of the suspect and made contact with the suspect. He advised her of her Miranda Rights before questioning her. He advised her that the security footage from the store shows her placing the wine in her purse. Ellis allegedly stated that she had not opened the wine and that it was inside the residence. She advised the officer that she had been convicted of shoplifting in the past and she retrieved the wine and it was placed into evidence.
Hawkins then traveled to Shop-n-Save and made contact with the acting manager who provided him with the store security footage of the date and time in question.
On the same date Hawkins requested the criminal history of the suspect and it showed a previous Shoplifting 3rd Offense conviction on July 25, 2019.
On Tuesday, July 23 Hawkins reviewed the security footage and observed the suspect remove several unknown items from the shelves and place them in her pants and her handbag. He observed nine instances of the suspect placing items in her handbag or pants.

During the review of the security footage, Clemente can be seen pointing out an item on the shelf to Elis, who can be seen removing the item and allegedly putting it in the waistband of her shorts. Immediately Clemente removed an item and directly hands it to Ellis who then allegedly puts it in her shorts. Clemente can then be seen handing Ellis another item which she allegedly places inside her handbag.
Chad Richard Friend, of Friendsville, MD, was charged with Driving Revoked for DUI. The complaint states that Deputy B.M. Gidley was running a stationary patron on US48 in Davis when he noticed a gray pickup traveling westbound. He noticed there was no license plate on the truck, he pulled out and caught up with the pickup and then noticed there was a plate but it was illegible due to dust that covered it. Gidley made contact with the driver who was identified as Chad Friend. He advised the driver why he was pulling him over and requested the vehicle information and driver’s license. The driver could not pro-vide his license due to it being in his locker at work. Gidley ran the driver’s information through Tucker County 911 who advised him that the license was revoked for DUI. Gidley requested a Triple III to be run on Friend along with the certified driver’s history. Friend had been arrested on May 7, 2022 for DUI in Tucker County and the effective date of suspension was September 6, 2022. He was also arrested for Driving Revoked for DUI 1st Offense. Gidley transported Friend to the WVSP detachment for processing and then onto TVRJ for arraignment.
Christopher Guy Ross, of Elkins, was charged with one count of Domestic Battery. According to the complaint on Saturday, July 13 Trooper R.S. Musgrave was requested by EMS for an individual needing law enforcement.
Musgrave arrived at EMS and made contact with Dale Tincher who advised he was allegedly beaten up by Christopher Ross. He stated they were on the porch drinking together and a verbal argument broke out. He stated Ross allegedly began striking him in the head and facial area, along with his chest and ribs.
At this time Musgrave observed injuries consistent with the statement. He obtained a recorded statement and pictures of the injuries.
On the same date Musgrave traveled to the residence where this incident occurred. He observed empty alcoholic beverages along with a small puddle of what he acknowledged as blood, again, consistent with the victim’s statement.
All the above incidents occurred in Tucker County and all suspects are considered innocent until proven otherwise in a court of law.
