The following criminal complaints have been filed in the Tucker County Magistrate office:
Katherine Marrlea Spessert, of Montrose was charged with one count Domestic Assault and one count of Possession of Marijuana (less than 15 grams). According to the complaint, Corporal N.C. Gidley received a call from Tucker County 911 in regard to an altered mental status in Parsons. Upon arriving on scene, officers met with Katherine Marrlea Spessert who appeared to be upset, verbally arguing with a female subject, herby called the victim.
Gidley spoke with the victim who stated, in summary, that she had been receiving threatening text messages from the accused in reference to a child custody issue prior to the incident. Upon meeting with the accused, the victim stated that the accused was being verbally aggressive towards her and threatened her multiple times while “in her face.” The victim stated that the accused, at one point, threatened the victim’s life. When the victim was asked if she felt threatened and or in fear for her safety and life, the victim stated that she did.
Other officers on scene located what appeared to be a green leafy substance consistent with marijuana inside the vehicle the accused was in. She accepted ownership of the suspect marijuana and stated that she had a medical marijuana card, however, a glass smoking device was located with what appeared to be burnt marijuana inside of it. The suspect also made an excited utterance stating that she had “smoked a bowl.” The suspect marijuana was located in a black container, which housed a plastic bag that contained the green leafy substance. From Gidley’s training and experience, medical marijuana does not come from and is not stored in a plastic sandwich bag when it comes from the dispensary. Also, medical marijuana is not to be consumed using a glass smoking device and fire.
Dalton James Roy, of Davis, was charged with one count of Obstructing. On Friday, April 17, at approximately 9:57 p.m. Sr. Trooper R.S. Musgrave, along with Trooper Hahn, Deputy Gidley and Cpl. Gidley were dispatched to a domestic in Davis. At this time the caller advised the neighbors were screaming and banging, along with a juvenile stating, “daddy you killed mommy” and a male stating, “she’s not dead, she’s still breathing.”
At approximately 10:13 p.m. these officers arrived on scene and were advised it was Dalton Roy. Due to previous law enforcement interactions, Musgrave had knowledge to which apartment Roy lived. At this time, he attempted to make contact with the female subject but received no answer. The officers located Roy laying in a nearby vehicle. He asked Roy for his key and Roy stated, “you’re not going in my ****** house without a warrant.” Due to this response, Roy was obstructing these officers from investigating a possible domestic with exigent circumstances.
At this time, Roy was turned towards Musgrave in an aggressive manner with his fists balled and began to move towards the officer. This is a sign of aggression towards law enforcement. At this time, Roy was lawfully detained in order to continue this investigation. He was then transported to the West Virginia State Police Parsons Detachment for processing. He was then transported to Tygart Valley Regional Jail and remanded into custody for community corrections.
