Michael Glade Bennett, of Hambleton, was charged with Driving revoked with DUI and DUI Third offense. According to the criminal complaint, on Saturday, March 8 Tucker County 911 dispatched the Tucker County Sheriff’s Office to the scene of an ATV accident on Sugarlands Road near the intersection of US219. When officers arrived on scene, the defendant was being cared for by Tucker County EMS.
The officer observed a blue Suzuki Kingquad 750 rolled over on its side. Allegedly, evidence on scene showed skid marks leading to dig marks in the pavement where the ATV appeared to have rolled over.
After conducting a DMV check of the defendant’s license status it was confirmed that his right to operate a motor vehicle had been revoked for DUI effective date of December 19, 2013. The complaint also states that the fire department on scene allegedly found a bottle of Captain Morgan near the accident scene.
On Tuesday, March 11, a court order was written and signed by a Circuit Court Judge for Garrett County Memorial Hospital to release any and all Blood Alcohol Test Results concerning the defendant taken on March 8. According to the medical records obtained from the hospital, the defendant had a medical blood alcohol level of 349 at the time he was admitted which converts to a .300% BAC by Law Enforcement standards.
It should be noted that the defendant has two prior DUI Offense convictions on August, 20, 2009 and September 26, 2013. All individuals involved are innocent until proven guilty by a court of law.
The case for Driving revoked with DUI was before Magistrate Carol D. Irons and a $500 PR bond was posted. For the DUI Third Offense case Bennett posted a $5,000 PR bond and a preliminary hearing is scheduled for May 5 at 2 p.m. before Magistrate Carol D. Irons.
