Circuit Court Judge, Lynn A. Nelson, sentenced a man to prison for local drug store robbery.
John Joseph Morton, Jr., 29, was originally arrested in July 2013 for robbing the Rite Aid Pharmacy in Parsons. Nelson sentenced him to five to 18 years in prison on Monday, June 2. Morton allegedly robbed the pharmacy taking approximately 300 Percocet pills.
Also being heard in Circuit Court on Monday before Judge Nelson were the following:
Philip A. Phillips, Sr, of Davis, was originally indicted in February, but those charges were dismissed in March because of incorrect information in the original indictment. Those charges could not be brought up again because they were dismissed without prejudice.
On Monday, June 2, Phillips was charged with three counts of second degree sexual assault, one count of first degree sexual abuse, six counts sexual abuse by parent or guardian and 2 counts third degree abuse. On June 9, before Judge Lynn A. Nelson, bond was set at $10,000, he is to have no contact with victims and a pre-trial conference has been scheduled for July 12 at 9:30 a.m.
James Waybright, of Parsons, was originally indicted on one count of first degree sexual assault. Waybright allegedly had intercourse with the victim on July 4, 2013 after she told him she did not want to have sex with him. A pre-trial hearing has been set for July 10 at 9:30 a.m.
Charles W. Miller, Jr., of Thomas, was originally indicted on three counts of sexual assault in the third degree, three counts of abuse of an incapicated person and three counts of sexual abuse by parent or guardian. Nelson set bond for Miller at $25,000 PR and a pre-trial hearing is set for July 10 at 9:30 a.m. Miller is to have no contact with the alleged victim.
George Keihl was originally indicted for reporting a false claim. He is currently housed in the Tygart Valley Regional Jail but the Defendant and State agree that Keihl should undergo an independent psychiatric evaluation to see if he is a likely candidate for probation. Bond was set at $10,000 PR and a pre-trial conference is set for July 10 at 9:30 a.m.
Jessica Poe, of Hambleton, was placed back on her terms of probation after being arrested for violating those terms. Nelson ordered that Poe be released and must reenter the Community Corrections Program. Her term of probation had begun on January 16 and she will stay on probation for five years. She was indicted in October by a Tucker County Grand Jury for two felony counts of child neglect creating a risk of injury. She had been pulled over in August for reckless driving.
