Nelson Sets Hearing and Trial Dates

Five Tucker County residents, who were indicted by a grand jury earlier, appeared in Circuit Court before the Honorable Lynn A. Nelson to set trial dates.

Justin Liedy On Nov. 4, in front of Judge Lynn A. Nelson, Tucker County Prosecutor, Ray LaMora, III informed the court of arrears in monitoring fees against the defendant from the Randolph County Sheriff’s office of $550. The Court ordered this amount be released to the Randolph County Sheriff’s office from the posted bond of the defendant.

On Nov. 4 before Judge Lynn A. Nelson, the State of West Virginia asked to withdraw the Probation Violation acknowledging that the defendant, Justin Liedy, has been following the orders of his probation officer to this point. The defendant is to be readmitted to the Electronic Monitoring as was previously ordered by the Court with the same terms and agreements as were in place earlier. Monitoring will be supervised by the Randolph County Sheriff’s Department.

Jessica Poe-On Nov. 4, Poe was before Judge Lynn A. Nelson for a Scheduling Hearing. She was indicted in October by a Tucker County grand jury for two felony counts of child neglect creating a risk of injury. In August, she was pulled over for reckless driving. Upon inspection, officers found a four year old and a two year old child in the back seat. Neither child was wearing any type of child restraints or car seats. All parties return on Dec. 9 at 9:30 a.m. for a Plea/Scheduling Hearing.

John J. Morton, Jr.- On Nov. 4, Morton was before Judge Lynn A. Nelson for a Scheduling Hearing. Morton was indicted on one count of felony first-degree armed robbery and one count of battery and one count of assault, both misdemeanors. On July 16, Morton entered the Parsons Rite-Aid and used a gun to rob the pharmacy of prescription drugs. All parties return on Dec. 9 at 9:30 a.m. for a Plea/Scheduling Hearing.

Kenneth Fansler came before Judge Lynn A. Nelson on Nov. 4 for a Scheduling Hearing. He was indicted on two counts of intimidating a witness, which is a felony. On June 1 Fansler approached the victim in an attempt to intimidate her over the case that is with Fansler’s wife Renee. Pretrial Conference will take place on Jan. 16, 2014 at 10:30 a.m. Trial on these matters will take place on Feb. 27, 2014 following jury selection at 9 a.m.

Renee Fansler came before Judge Lynn A. Nelson on Nov. 4 for a Scheduling Hearing. Fansler was indicted on seven felony counts of fraud with an access device. In May, Fansler used a food stamp card belonging to Amber Burns on seven different occasions. Pretrial Conference will take place on Jan. 16, 2014 at 11 a.m. Trial on these matters will take place on Feb. 13, 2014 following jury selection at 9 a.m.
