The following criminal complaints have been filed in the Tucker County Magistrate office:
Angela K. Neu, was charged with one count of Driving under the influence of alcohol. The complaint states that on Monday, June 1 Cpl. C.R. Summerfield of the Tucker County Sheriff’s office (TCSO) was patrolling Parsons when he observed a vehicle sitting at the Pulp Mill Bottom Baseball field. He observed the vehicle to be running with the headlights on. He approached the vehicle and spoke with the driver, a female subject namely Angela Neu. She stated she did not have any identification with her but provided her name and date of birth. She also provided the vehicle registration.
Upon speaking with her the officer could smell the odor of alcohol. Her eyes were bloodshot and glassy and her speech was slurred. He observed two bottles of alcohol in the passenger seat. PFC N. Gidley of the Parsons Police Department (PPD) arrived on scene and observed an additional bottle of alcohol in the backseat of the vehicle. Summerfield directed Neu to step out of the vehicle to perform field sobriety tests which she failed. During the Breath test she provided an insufficient breath sample with no reading. He placed her under arrest and transported her to the PPD for the intoximeter. After reading and explaining the West Virginia implied Consent Statement Nue refused the test. After a period of 15 minutes, she refused the test again.
Jason Lee Fischer, of Broken Bow, OK was charged with one count Obstructing an Officer and one count of Assault. According to the complaint, on Sunday, May 31 Cpl. C.R. Summerfield of the Tucker Count Sheriff’s office (TCSO) and Trooper D. Tate of the West Virginia Stat Police (WVSP) were dispatched to 658 Henry Avenue in Davis by the Tucker County Communications (911). 911 advised of a physical altercation between male subjects. 911 advised that three men were staying together at a residence and the caller lacked himself in a room while the other gentleman was handling the intoxicated individual. Officers arrived on scene and were met outside by Jason Fischer and William Buyd Roberson. Fischer appeared to be intoxicated. Upon speaking with both parties, it was discovered that the two subjects got into a verbal argument. Fischer allegedly swung at Roberson attempting to hit him. Roberson allegedly then struck Fischer. While attempting to gather further information from Roberson, Fischer was instructed to go back inside of the house multiple times. Fischer continued to open the door and walk outside to where the officers were speaking with Roberson.
Raymond Harvey Deaver, of Brambleton, Va, was charged with one count of Domestic Battery and one count of DUI 1st. According to the complaint, on Wednesday, June 3, at approximately 7:55 p.m., Trooper D.M. Tate was dispatched by Tucker County 911 to a single-vehicle accident on US219, near the Tucker-Randolph County line, to assist Tucker County Sheriff’s Deputy T. Zirk.
Tate arrived on scene, activated his body-worn camera and observed a tractor trailer that had jackknifed off the roadway. Contact was made with the driver, identified as Raymond Deaver (accused) and a female passenger (victim).
A strong odor of alcohol was detected coming from the vehicle. Both individuals stated they had been consuming alcohol prior to the incident. The accused displayed multiple indicators of impairment.
The victim stated that the accused had consumed vodka before operating the truck and that he had physically assaulted her. Tate observed the victim to have a swollen eye and a puffy right cheek consistent with being struck.
The accused was asked to submit to a preliminary breath test (PBT) which he refused.
Tate then placed the accused into custody and transported him to the West Virginia State Police Detachment for intoximeter testing. The accused provided a breath sample resulting in a 0.104 BAC and admitted to consuming vodka earlier in the day and prior to operating the vehicle. It is noted the accused holds a CDL license.
